body
Summary
The Municipal Improvement Act of 1913 (“Act”) requires that an engineer prepare a report each tax year for every maintenance district for which assessments will be levied and collected. The work generally consists of preparing an engineer’s report for zones within the Stockton Consolidated Storm Drainage Maintenance Assessment District No. 2005-1 and for six industrial storm drainage basin maintenance assessment districts. The report includes the district’s annual budget, a description of the improvements to be maintained, and the preparation and submittal of the assessment rolls.
If approved by the City Council, this action will award a Professional Services Agreement to Siegfried Engineering, Inc. in an amount not to exceed $489,085 for an initial five-year term. The agreement includes an option to extend for up to two additional years for annual Engineer’s Reports, budgets, assessment calculations, assessment rolls, and related professional services.
DISCUSSION
Background
The City Council approved Resolutions 85-0416, 86-1059, 88-0492, 88-0552, and 99-0400, authorizing the formation of five storm drainage basin maintenance assessment districts.
In addition, by Resolution No. 2020-12-15-1501, the City Council later approved the formation of a sixth district. These storm drainage basins are all located in industrial areas and serve to control flooding.
On July 26, 2005, the City Council adopted Resolution 05-0392 to establish an assessment district designated as the “Stockton Consolidated Storm Drainage Maintenance Assessment District No. 2005-1,” which provides funding for the operation, maintenance, and replacement of stormwater quality treatment devices that are required by the City’s Stormwater National Pollutant Discharge Elimination System Permit. The formation of each of these districts was based on the provisions of the Municipal Improvement Act of 1913 and the Stockton Improvement Procedure Code.
Present Situation
On July 7, 2026, MUD staff published a Request for Proposals (RFP) for storm drainage assessment district engineer's reports, budgets, and related professional services.
On August 13, 2026, the City received four proposals from the following firms:
• Siegfried Engineering, Inc. of Stockton, California
• Harris & Associates of Concord, California
• NBS of Temecula, California
• SCI Consulting Group of Fairfield, California
A selection committee evaluated the proposals in accordance with the criteria established in the RFP. Siegfried Engineering, Inc. was determined to be the highest-ranked responsive proposer.
Following the evaluation process, staff negotiated a Professional Services Agreement with Siegfried Engineering, Inc. in an amount not to exceed $489,085 over the five-year contract term.
FINDINGS
In accordance with Stockton Municipal Code (SMC) section 3.68.070, the City Council may approve findings that support and justify an exception to the competitive bidding process. The following findings support and justify an exception:
1. The scope and complexity of preparing annual engineer’s reports, budgets, assessment calculations and assessment rolls require specialized technical expertise that cannot be adequately evaluated through a strict low bid process.
2. Use of the RFP process is appropriate for this Professional Engineering Services Agreement because selection relies on the evaluation of professional qualifications and performance as the basis for selection.
3. Siegfried Engineering Inc. has demonstrated the professional qualifications, experience, and capacity necessary to perform the required services, and selecting the firm through an RFP process ensures the City receives high-quality and reliable work.
4. The City negotiated a contract following solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.
FINANCIAL SUMMARY
The total amount of the Agreement shall not exceed $489,085 for the five-year contract term.
Funding for the Professional Services Agreement with Siegfried Engineering, Inc. is generated by annual assessments levied within the Consolidated District and Industrial Districts. Costs will be charged to the applicable district and zone expense accounts. Costs for subsequent fiscal years will be budgeted and subject to City Council approval through the annual budget process.
This action has no impact to the General Fund or any other unrestricted funds.
