ADOPT RESOLUTION TO AUTHORIZE THE TRANSFER OF FUNDS FOR STREETSCAPE MAINTENANCE AND UTILITIES IN CANNERY PARK

RECOMMENDATION
It is recommended that the City Council adopt a resolution authorizing the transfer of funds in the amount of $37,630 from Cannery Park Zone A-10 of the Stockton Consolidated Landscape Maintenance Assessment District No. 96-2 Reserve for Continuing Appropriations Account to the Cannery Park Zone A-10 Operating Budget.
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
The City is responsible for the maintenance of streetscape landscaping within the Stockton Consolidated Landscape Maintenance Assessment District (SCLMAD) No. 96-2 Cannery Park Zone A-10. As a condition of development, developers are required to provide streetscape landscaping in new neighborhoods. The budget for Fiscal Year (FY) 2025-26 SCLMAD No. 96-2 Cannery Park Zone A-10 did not include maintenance and utility costs the City will be assuming at the expiration of the developer's maintenance period.
It is recommended that Council adopt a resolution authorizing the transfer of funds in the amount of $37,630 from Cannery Park Zone A-10 of the SCLMAD No. 96-2.
DISCUSSION
Background
On September 27, 2005, by Resolution No. 05-0442, Cannery Park Zone A-10 of the SCLMAD No. 96-2 was approved by Council. Cannery Park Zone A-10 is located in the northeast part of the City, generally bounded by Eight Mile Road on the north, State Route 99 on the east, existing residential on the south, and the Union Pacific Railroad line on the west. Improvements maintained include masonry back-up walls, landscaping and irrigation, graffiti abatement, street lighting, parks, and bicycle and pedestrian pathways.
On June 3, 2025, by Resolution No. 2025-06-03-1605, Council adopted the FY 2025-26 Annual Budget for Cannery Park Zone A-10, along with the Annual Budgets for all SCLMAD No. 96-2 Zones following a duly noticed budget study session and a public hearing. Budgeted expenditures include contracted maintenance, utilities, administration, repair and replacement of plant material and infrastructure, allocation to the replacement reserve, and a contingency.
Present Situation
The City is responsible for the maintenance of streetscape landscaping within the Stockton Consolidated Landscape Maintenance Assessment District (SCLMAD) No. 96-2 Cannery Park Zone A-10. As a condition of development, developers are required to provide streetscape landscaping in new neighborhoods.
Landscaping along PFC Jesse Mizener Street and Holman Road have been completed and are in the establishment period. After the developer's maintenance period expires, the City will accept and assume maintenance responsibility of the landscaping and utilities. The budget for FY 2025-26 SCLMAD No. 96-2 Cannery Park Zone A-10 did not include additional maintenance budget. Therefore, the operating budget for Cannery Park Zone A-10 does not have sufficient maintenance and utility costs.
FINANCIAL SUMMARY
A transfer of funds in the amount of $37,630 from the SCLMAD No. 96-2 Reserve for Continuing Appropriations Account to the Cannery Park Zone A-10 Operating Budget is recommended to fund the streetscape maintenance and utilities and will allow the remaining FY 2025-26 budgeted contingency funds to be available for any unanticipated expenses that may occur between now and the end of the fiscal year. Cannery Park Zone A-10 has sufficient funding available in the Reserve for Continuing Appropriations Account to support these actions.
