RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Approve findings pursuant to Stockton Municipal Code section 3.68.070 which support and justify an exception to the competitive bidding process.

 

2.                     Ratify the final expenses in the amount of $624,765 to Soracco Inc, of Lodi, California, for all costs related to the repair of the sanitary sewer pipeline at Alexandria Place.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

On August 5, 2024, a sinkhole was reported at Alexandria Place near Lincoln Road. The Municipal Utilities Department (MUD) and Public Works (PW) staff investigated the extent of the sinkhole and determined the cause was due to the failure of a large sanitary sewer pipeline beneath the roadway. The sinkhole was determined to pose a threat to public welfare and safety. City staff immediately established traffic control and solicited bids for emergency repairs to the sanitary sewer pipeline and impacted roadway.

 

On August 15, 2024, the City Manager approved the MUD request for emergency procurement authorization for the repair of the Alexandria Place sanitary sewer pipeline in accordance with Stockton Municipal Code section 3.68.070 and City Manager Emergency Contract and Procurement Policy (17.05.150).

 

If approved by the City Council, this resolution will approve findings pursuant to Stockton Municipal Code section 3.68.070 which support and justify an exception to the competitive bidding process, and ratify the total expenditure of $624,765 for emergency sanitary sewer pipeline repair at Alexandria Place by Soracco Inc.

 

DISCUSSION

 

Background

 

On August 5, 2024, a sinkhole on Alexandria Place was reported to the MUD Collections division. MUD staff used CCTV cameras to perform a video inspection of the 36-inch sanitary sewer pipeline directly below the sinkhole. The inspection found an 80-foot section of 36-inch sanitary sewer pipeline was in critically poor condition and required replacement to prevent further roadway damage and hazard to public health.

 

On August 15, 2024, the City Manager approved the MUD request for emergency procurement authorization for the sinkhole repair and pipeline replacement at Alexandria Place in accordance with the City Manager Emergency Contract and Procurement Policy (17.05.150).

 

On August 19, 2024, staff solicited bids for emergency sanitary sewer pipeline repair for the pipeline located at Alexandria Place. The City received one bid from Soracco Inc, for $624,765. MUD staff scheduled repairs to occur between September 28, 2024 and October 7, 2024 to coincide with the Lincoln High School fall break to minimize traffic congestion and further impacts to the community during regular school hours. By October 4, 2024, Soracco completed all repairs and remediation work, three days before the project deadline.

 

Present Situation

 

On October 7, 2024, Soracco Inc, submitted the final cost of $624,765 to repair and replace the 80-foot section of sanitary sewer pipeline, and remediate road damage caused by the sinkhole. All costs incurred under this emergency procurement in the amount of $624,765 have been paid by the City.

 

Under the City Manager Emergency Contract and Procurement Policy (17.05.150 Section 4) and Stockton Municipal Code section 3.68.070, the MUD is required to make a record of all emergency purchases of supplies and services of more than $100,000 and report to the City Council for ratification at the next Council meeting or no later than sixty (60) days following execution of the emergency procurement. Based on the 60-day rule, the ratification of the cost to repair the sanitary sewer pipeline at Alexandria Place was scheduled for the City Council meeting on December 3, 2024.

 

Findings

 

Pursuant to the Stockton Municipal Code (SMC) section 3.68.070, the City Council may approve findings which support and justify an exception to the competitive bidding process. The following findings support and justify an exception:

 

1.                     A sinkhole on the roadway at Alexandria Place near Lincoln Street was reported to the City and determined to be caused by a failed sanitary sewer pipeline.

 

2.                     Emergency repair and remediation of the sanitary sewer pipeline and impacted roadway was necessary to protect public health and safety.

 

3.                     Soracco Inc was a responsive contractor that was available and capable of completing the necessary repairs and remediation in the best interest of the public.

 

4.                     Repairs and remediation of the Alexandria Place sanitary sewer pipeline was completed October 4, 2024.

 

Staff recommends the City Council approve findings pursuant to Stockton Municipal Code section 3.68.070 which support and justify an exception to the competitive bidding process and ratify the total expenditure of $624,765 for emergency repair and remediation Alexandria Place sanitary sewer pipeline by Soracco Inc.

 

FINANCIAL SUMMARY

 

There are sufficient funds in the Sanitary Sewer System Emergency capital improvement project fund (UW24018) for the emergency repairs and remediation services provided by Soracco Inc.

 

There is no impact to the General Fund or any other unrestricted fund, from this action.
