APPROVE MOTION TO AUTHORIZE BALANCING CONTRACT CHANGE ORDER NO. 2 FOR THE OAK PARK SENIOR PARKING LOT RESURFACING PROJECT

RECOMMENDATION
It is recommended that the City Council approve a motion to authorize Balancing Contract Change Order No. 2, in the amount of $155,744.10, with George Reed, Inc. for the Oak Park Senior Parking Lot Resurfacing, Project No. WD22012.
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary
On May 14, 2024, by Resolution No. 2024-05-14-1222, Council awarded a Construction Contract in the amount of $680,000 to George Reed, Inc. of Modesto, CA, to complete the Oak Park Senior Parking Lot Resurfacing, Project No. WD22012. The project included resurfacing the Oak Park Senior Center parking lot, removing and replacing the existing curbs, gutters, sidewalks, stripes, and parking signage, and installing Americans with Disabilities Act (ADA) compliant curb ramps and driveways (Attachment A).
During construction, constructability issues and unforeseen field conditions changed the character of the project. Contract Change Order (CCO) No. 1 in the amount of $157,555.49 was approved to address subgrade issues, provide additional topographic surveys, and install concrete drain inlets. The final Balancing CCO No. 2 is needed to compensate the contractor for final expenses and close out the contract. Council approval is required for Balancing CCO No. 2, as the cumulative amount exceeds the administrative change order authority allowed under the existing contract.
Staff recommends that Council approve Balancing CCO No. 2 in the amount of $155,744.10 with George Reed, Inc. (Attachment B). The total final contract value will be $993,299.59. The project is complete, and Balancing CCO No. 2 will close out the Construction Contract.
DISCUSSION
Background
On November 16, 2021, by Resolution No. 2021-11-16-1501, Council allocated $12.7 million in discretionary funding for various parks, trees, transportation, and facility projects Citywide to benefit our community. The funding provided $615,000 for the Oak Park Senior Parking Lot Resurfacing project.
Design of the Oak Park Senior Parking Lot Resurfacing project was completed in November 2024, and the project was advertised for construction bids. On May 14, 2024, by Resolution No. 2024-05-14-1222, Council awarded a Construction Contract in the amount of $680,000 to George Reed, Inc. of Modesto, CA.
The project required the contractor to resurface the parking lot adjacent to the Senior Center within Oak Park. The project included removal and reconstruction of failed curbs, gutters, and sidewalk segments adjacent to the parking lot, preserving existing survey monuments, installing pavement markers and striping, adjustment of existing utilities to pavement finished grade, parking signage, and installing ADA-compliant curb ramps and driveways (Attachment A).
The constructability issues and unforeseen field conditions encountered during construction changed the character of the entire project. CCO No. 1, in the amount of $157,555.49, was approved to address subgrade issues, provide additional topographic surveys, and install concrete drain inlets.
Present Situation
Balancing CCO No. 2 is necessary to compensate the contractor for extra work associated with pavement repairs, additional asphalt, and other work to complete the project. This is the final Balancing CCO to close out and complete the Construction Contract. Council approval is required for Balancing CCO No. 2, as the cumulative amount exceeds the administrative change order authority allowed under the existing contract.
Staff recommends Council approve Balancing CCO No. 2 in the amount of $155,744.10 with George Reed, Inc. (Attachment B). The total final contract value will be $993,299.59.
FINANCIAL SUMMARY
There is sufficient funding in the Oak Park Senior Parking Lot Resurfacing, Project No. WD22012, to approve Balancing CCO No. 2 with George Reed, Inc. in the amount of $155,744.10. With the approval of Balancing CCO No. 2, the final contract amount is $993,299.59.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended action.
