RECOMMENDATION

 

It is recommended that the City Council approve a motion to authorize the City Manager to execute Professional Services Contract Amendment No. 7 in the amount of $200,000 with Studio Miers Chou Poon for additional design support services during construction for the Animal Shelter Renovation, Project No. P023001.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary

 

On May 24, 2022, by Resolution No. 2022-05-24-1504, Council authorized the award of a Professional Services Contract in the amount of $712,809 to Studio Miers Chou Poon (formerly Swatt Miers Architects) of Emeryville, CA, for professional design services of the Animal Shelter Renovation, Project No. P023001.  The project will add a cattery, medical facilities, staff offices, restrooms, animal isolation and rehabilitation areas, and conference room space. In addition, the existing Animal Shelter building will receive upgrades, and existing modular buildings will be repurposed. 

 

The contractor, architect, and construction management staff all collaborate to resolve construction issues. However, many changes require the architect to respond with information and/or provide alternate design details during construction. To date, six Professional Services Contract Amendments totaling $165,935 have been approved with Studio Miers Chou Poon. The project construction is approximately 60 percent complete and additional services are required from Studio Miers Chou Poon to complete and closeout the project.

 

Professional Services Contract Amendment No. 7, in the amount of $200,000, requires Council authorization as the cumulative amount of Professional Services Contract Amendments Nos. 1 through 6 exceed the administrative change order authority available.

 

It is recommended that Council approve a motion authorizing the City Manager to execute Professional Services Contract Amendment No. 7 in the amount of $200,000 with Studio Miers Chou Poon for additional design support services during construction for the Animal Shelter Renovation, Project No. P023001.

 

 

 

DISCUSSION

 

Background

 

The Animal Shelter facility is located at 1575 South Lincoln Street in Stockton, CA (Attachment A). The facility currently operates with 18 full-time employees and 30 contract and volunteer workers. The Animal Shelter provides medical treatment for up to 10,000 animals annually including spay/neuter, emergency, and dental care.

 

The Animal Shelter Renovation project includes updating the existing facility and construction of a new building to improve overall functionality and operations. The project will add a cattery, medical facilities, staff offices, restrooms, animal isolation and rehabilitation areas, and conference room space. Updates to the existing Animal Shelter will include the addition of a new façade, network upgrades, backup generator, uninterrupted power supply, a new industrial freezer, and repurposing existing modular buildings on site.

 

On May 24, 2022, by Resolution No. 2022-05-24-1504, Council awarded a Professional Services Contract in the amount of $712,809 to Studio Miers Chou Poon (formerly Swatt Miers Architects) of Emeryville, CA, to prepare the plans, specifications, and estimates for the construction of the Animal Shelter Renovation, Project No. P023001.

 

Architects play an integral role in providing design support during construction. The contractor, architect, and construction management staff all collaborate to resolve construction issues. However, many changes require the architect to respond with information and/or provide alternate design details during construction. Depending on the size and complexity of the project, changes and field conditions can require consistent attention until the project is complete.  Studio Miers Chou Poon allotted just over one percent of their original fee for construction support.  Projects over $10,000,000, like the Animal Shelter Renovation project, commonly require at least three percent for construction support.  The Animal Shelter Renovation project recently experienced delays due to long lead time material availability and unforeseen utility conflicts.  These delays and other coordination issues required additional design details and support from the architect.  

 

To date, six Professional Services Contract Amendments totaling $165,935 have been approved with Studio Miers Chou Poon.  The project construction is approximately 60 percent complete and additional services are required from Studio Miers Chou Poon to complete and closeout the project.

 

Present Situation

 

Professional Services Contract Amendments Nos. 1 through 6 with Studio Miers Chou Poon were previously approved for various changes needed during the design and construction phases.  Amendments 1 through 6 included additional services for ballistic glass and public counter changes; play yard design including covered structure, sewer and drainage modifications; electrical service and foundation revisions; and addition coordination during construction.  

 

Studio Miers Chou Poon has submitted Amendment No. 7 in the amount of $200,000 to provide continuing architectural support and direction to the contractor with design modifications resulting from ongoing field changes.  It is recommended that Council approve a motion to authorize Amendment No. 7 in the amount of $200,000 with Studio Miers Chou Poon for design support during construction for the Animal Shelter Renovation, Project No. P023001 (Attachment B).  The additional services will enable the architect to provide continued support through completion and closeout of the project. To date, 6 amendments totaling $165,935 have been approved with Studio Miers Chou Poon.  With approval of Professional Services Contract Amendment No. 7, the revised contract amount will Studio Miers Chou Poon will be increased to $1,078,744.  It is anticipated that the design will be completed in October 2026. 

 

FINANCIAL SUMMARY

 

There is sufficient funding in the Animal Shelter Renovation, Project No. P023001, to approve Professional Services Contract Amendment No. 7 with Studio Miers Chou Poon in the amount of $200,000.
