RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Authorize the City Manager to execute the Subdivision Agreement for Parcel Map COS 21-03;
2. Approve, accept on behalf of the public all offers of dedication, and authorize the City Clerk to sign and record the fully executed Parcel Map COS 21-03, and
3. Authorize the City Manager to take appropriate and necessary actions to carry out the purpose and intent of the resolution.

Summary
The proposed resolution authorizes the City Manager to execute the Subdivision Agreement with HPC Robinhood Investors, LP, a California Limited Partnership, accept all offers of dedication, and record Parcel Map COS 21-03. The subdivision contains 8.254 acres divided into seven (7) lots for commercial use. It is located at the northeast corner of Pacific Avenue and Robinhood Drive. See Attachment A - Vicinity Map.
Review and approval of the Subdivision Agreement and Parcel Map are necessary to ensure the Tentative Map (TM P20-0237) conditions are fulfilled. If the City Council approves the Parcel Map, the City Clerk will sign it and, when it is fully executed, will submit the Subdivision Agreement and map to the San Joaquin County Recorder.
Staff recommends that the Council adopt the proposed resolution as HPC Robinhood Investors, LP has fulfilled all necessary conditions.
DISCUSSION
Background
On May 13, 2021, the Planning Commission approved the Tentative Parcel Map (TM P20-0237), subject to conditions, for the parcel located at the northeast corner of Pacific Avenue and Robinhood Drive. The parcel is approximately 8.254 +/- acres to be subdivided into seven (7) lots for the purposes of creating seven (7) lots at the existing Robinhood Plaza Shopping Center.
Present Situation
HPC Robinhood Investors, LP submitted a parcel map (Parcel Map COS 21-03) to complete the subdivision process for the earlier approved Tentative Parcel Map. The subdivision contains 8.254 acres divided into seven (7) lots for commercial use. It is located at the northeast corner of Pacific Avenue and Robinhood Drive. Staff reviewed Parcel Map COS 21-03 and subdivision applications and determined that all conditions necessary for approval are met, which includes preparing improvement plans for all proposed public off-site improvements within the adjacent streets, including driveways into the project site, dedicating building setback easements, right of way easements, and utility easements, and posting security bonds to guarantee the subdivision improvements.
The City Engineer reviewed Parcel Map COS 21-03 for technical accuracy, substantial conformance with the approved tentative map, and the required conditions are completed or incorporated within a Subdivision Agreement. The City Engineer recommended forwarding the Parcel Map, Subdivision Agreement, and any offers of dedication to the City Council for consideration and approval.
The proposed resolution authorizes the City Manager to execute the Subdivision Agreement, accept on behalf of the public all offers of dedication, and record Parcel Map COS 21-03. The Subdivision Agreement (Exhibit 1 to the proposed resolution) contains the subdivider’s obligations for project site development.
Staff recommends that the Council adopt the proposed resolution as HPC Robinhood Investors, LP fulfilled all necessary conditions.
FINANCIAL SUMMARY
HPC Robinhood Investors, LP has paid the costs of creating the Subdivision Agreement for Parcel Map COS 21-03, including plan checking, inspection, map filing, and computer mapping services provided by City staff, in the amount of $19,891.05 and deposited in various fee accounts in the Development Services Fund. These fees and deposits are described in detail in Exhibit A of the Subdivision Agreement. All other fees will be assessed at the time building permits are issued.
There is no financial impact to the City of Stockton because of the execution of the Subdivision Agreement. The developer bears the costs of constructing the required infrastructure improvements and developing the parcels.
