RESOLUTION AUTHORIZING AN AGREEMENT WITH TNB CONSTRUCTION TO PROVIDE CONSTRUCTION SERVICES FOR IMPROVEMENTS AT LOUIS PARK BOAT LAUNCH FACILITY

RECOMMENDATION
It is recommended that the City Council adopt a Resolution:
1. Authorizing the City Manager, or designee, to execute an agreement with TNB Construction (Exhibit 1 to the Proposed Resolution), in the amount of $1.6 million, to improve the Louis Park Boat Launch facility in accordance with the Department of Boating and Waterways Grant scope.
2. Authorizing a contingency reserve to address unforeseen conditions or scope adjustments that arise during construction for a total project authorization not to exceed $2 million, and authorizing the City Manager, or designee, to approve contract amendments within the authorized contingency amount.
3. Authorizing the City Manager, or designee, to take all appropriate actions to carry out the purpose and intent of the Resolution.

Summary
The Louis Park Boat Launch Facility provides a convenient and centralized location for motorized and non-motorized access to the San Joaquin River. Approval will authorize an agreement with TNB Construction for the design and construction of improvements to the Louis Park Boat Launch facility. The project is funded through the Department of Boating and Waterways (DBW) Waterways Connections Initiative (WCI) grant program, which is intended to enhance accessibility and safety for both motorized and non-motorized vessels. Improvements to the Louis Park Boat Launch facility include installation of a low, free-board boarding float and gangway, concrete abutment, steel guide piles, two-unit unisex precast restrooms, and an ADA-compliant path of travel connecting the parking area and restrooms to the boarding float.
DISCUSSION
Background
On July 15, 2025, the Council approved Resolution 2025-07-15-1207 (Attachment A), accepting the award of $2M in grant funding for the Louis Park Boat Launch facility to enhance safety, improve accessibility, and increase overall usability of the facility for non-motorized boaters. The project was structured into two phases, with Phase One focused on permitting and preliminary design services, and Phase Two dedicated to final design and construction.
In September 2025, the City contracted with Anchor QEA to complete phase one of the project. This phase assisted the City in completing required environmental documentation, coordinating with regulatory and permitting agencies, and preparing preliminary design concepts necessary to advance the project toward final design and construction. This phase is still in progress and will transition directly into phase two, which will consist of final design and construction oversight of the identified improvements.
Present Situation
On February 5, 2026, the City issued a formal bid solicitation (PUR 26-021) for phase two of the Louis Park Boat Launch Improvement Project, which includes final design and construction services. The project was bid using a design-build delivery method to support the project schedule and construction including coordination of multiple components: in-water, landside, and the restroom. Three proposals were received in response to the solicitation, and TNB Construction was determined to be the lowest responsible bidder meeting the project scope requirements.
Due to grant funding timelines established under DBW WCI program, the project must be completed by February 2027. To support timely delivery of the project, the City’s phase one consultant will continue providing permitting coordination and regulatory support throughout phase two to ensure completion of design and construction activities.
ENVIRONMENTAL CLEARANCE
Due to the construction activities, CEQA compliance was required and completed by December 31, 2025 (Attachment B).
The Community Development Department (CDD) determined that the project qualified for a Categorical Exemption under CEQA Guidelines section 15301(d), as it involves the rehabilitation of existing facilities to meet current health and safety standards. The project is also consistent with the City’s General Plan, including Policy LU-6.3, which supports access to well-maintained public facilities.
FINANCIAL SUMMARY
DBW has set a limit for the current project at $1.6 million, but has set aside up to $400,000 for unforeseen costs and/or over-runs, accessible with their approval. The proposed Resolution allows for the award of the construction contract to TNB Construction in the amount of $1.6 million with City Manager authorization to approve and amend any over runs and/or additional needs should the state approve additional funding, up to $400,000. Council previously accepted and approved the general use of the full $2 million allocation available under the DBW WCI grant program for improvements to the Louis Park Boat Launch facility. Approval of this agreement will authorize the City to utilize up to the remaining available grant funds, as needed, for contingency, unforeseen conditions, permitting requirements, or scope adjustments associated with completion of the project. All project costs will be funded through the WCI grant program, and will cause no impact to the General Fund, as no matching funds are required.
