It is recommended that the City Council approve a motion to approve findings and authorize the purchase of seven 2014 BMW R1200RT-P police patrol motorcycles through the County of Los Angeles' contract with Long Beach BMW Motorcycles of Long Beach, CA in the amount of $184,731.61.  It is further recommended that the motion authorize the City Manager to take appropriate actions to carry out the purpose and intent of this motion.

Summary
 
The Public Works Department is recommending replacement of seven police patrol motorcycles used by the Police Department.   The seven units will be purchased through the County of Los Angeles' contract with Long Beach BMW Motorcycles of Long Beach, CA.  The cost of the replacement equipment is $184,731.61, and the purchase will be funded from the Fleet Internal Service Fund.  
 
DISCUSSION
 
Background
 
There are 26 units in the City's fleet of street use police patrol motorcycles.  Fourteen of these units were purchased between 2001 and 2005, and have either collision damage or mechanical problems that make them cost prohibitive to repair.  Seven of these units are out of service and are unusable; the other seven units are still in service with high mileage and are unreliable.  Current staffing in the Police Department Traffic Section does not require 26 units, and the 7 units that are unusable can be disposed of without immediate replacement.  The 2013-14 replacement budget for the Fleet Internal Service Fund includes funding to replace the 7 units that are currently being used but are unreliable.
 
The Harley-Davidson police patrol motorcycle has been used by the City as the standard unit since 1997.  However, as the City has not purchased any patrol units for several years, a re-evaluation of units currently available on the market was warranted.  Public Works and Police Department staff worked cooperatively to evaluate the models offered by the four manufacturers that currently produce police motorcycles (Victory, Honda, Harley Davidson, and BMW).  At the conclusion of this evaluation, the team concluded that the BMW R1200RT-P was the best fit for the City's immediate and long term needs.  The BMW unit was smooth riding and very responsive during aggressive high-speed road tests, and performed exceptionally well during fast start, high speed weaving, emergency braking, and other exercises designed to simulate some of the most extreme conditions associated with enforcement riding activities.  Police Department staff was impressed with the emergency lighting solutions offered and installed by the manufacturer (as opposed to lighting installed by a third-party up-fitter, which is common in the industry).  The design of the BMW unit results in an ergonomically preferable riding posture that provides a high level of rider safety while reducing the potential for tension and strain related to poor riding posture.  
 
Staff reviewed the cost of the units available from BMW, Harley-Davidson, and Victory (the Honda unit was the least preferred and cost was not evaluated).  The current cost of Harley-Davidson police patrol motorcycles quoted by the local Harley-Davidson vendor located in Lathrop, CA (with 3 percent local dealer preference) was compared to the cost of Harley-Davidson units from the California State Contract, Victory Motorcycles from their (non-local) dealer, and BMW motorcycles from the Los Angeles County contract.  The lowest cost unit was the BMW motorcycle from the Los Angeles County contract at a cost of $26,390.23 per unit (see Attachment A for cost comparison).
 
Present Situation
 
As the BMW unit was preferred by the evaluation team and also has the lowest total cost, the Fleet Manager recommends the replacement purchase of seven new BMW R1200RT-P motorcycles using the Los Angeles County contract with Long Beach BMW Motorcycles.  There is no local vendor for BMW motorcycles.  The specification used by the County of Los Angeles meets the City's requirements for this type of equipment.  To minimize the administrative costs associated with purchasing such units, it is proposed to purchase the new units from Long Beach BMW Motorcycles by utilizing a cooperative purchasing agreement with the County of Los Angeles.  Use of this type of cooperative purchasing agreement reduces the net purchasing cost by obtaining low bids through a competitive bid process without the expenses associated with conducting the bid process.  Staff time and associated costs to develop specifications and prepare documents are minimized.
 
Delivery time for the new units is approximately 31 days once the equipment is ordered.  
 
Findings
 
Stockton Municipal Code Section 3.68.070 (B) provides for an exception to the competitive bidding requirements in cases where Council has approved findings which support and justify the purchase through a cooperative purchasing agreement.  Proposed findings to support this purchase are as follows:
 
1)      The County of Los Angeles has established a cooperative purchasing agreement for the purchase of seven BMW R1200RT-P motorcycles.
2)      The County of Los Angeles established this cooperative purchasing agreement pursuant to a competitive bidding process.
3)      The bid specification used by the County of Los Angeles has been assessed as compatible to the City's standards.
 
Staff recommends the replacement purchase of seven motorcycles through the above-mentioned cooperative purchasing agreement.  
 
FINANCIAL SUMMARY
 
There are sufficient funds available in the Fleet Internal Service Fund, Account No. 501-5060-670.80-02 for the purchase of seven BMW R1200RT-P motorcycles at a unit price including tax of $26,390.23 (Attachment B) for a total purchase price of $184,731.61. It is recommended that the motion approve the indicated findings, and authorize the City Manager make the purchase and take any other actions that are appropriate and required to carry out the purpose and intent of the motion.

There is no impact to the City's General fund or to any other unrestricted fund as a result of taking the recommended action.
