APPROVE MOTION TO AUTHORIZE THE WEBER POINT EVENTS CENTER FOUNTAIN MAINTENANCE PROJECT

RECOMMENDATION

 

It is recommended that the City Council approve a motion to:

 

1.                     Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.

 

2.                     Award a three-year Service Contract in the amount not to exceed $241,848 to All Seasons Pool Service of Lodi, CA, for the Weber Point Events Center Fountain Maintenance, Project No. OM-26-003.

 

3.                     Authorize the City Manager to execute up to two one-year extensions to this Service Contract, at an annual cost not to exceed $113,111, for a cumulative contract total not to exceed $468,070.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary

 

The City is responsible for the maintenance of 66 parks, seven pools, and eight splashpads, including the fountain at the Weber Point Events Center (WPEC). The WPEC Fountain is open for public use from the Saturday of Memorial Day weekend through Labor Day (Attachment A). The Fountain requires maintenance twice a day during summer months, and at least once a week during winter months, to monitor and maintain the electrical and chemical system.

 

On October 30, 2025, the City advertised a Request for Proposals (RFP) for the WPEC Fountain Maintenance, Project No. OM-26-003. On December 3, 2025, two firms submitted proposals for this project. The Selection Committee evaluated the proposals and found All Seasons Pool Service of Lodi, CA, to be the most qualified and highest ranked company.

 

It is recommended that Council approve a motion authorizing the City Manager to execute a three-year Service Contract, in the amount not to exceed $241,848, with All Seasons Pool Service (Attachment B).  This Service Contract contains renewal options for up to two one-year extensions at $113,111 each, for a cumulative contract total not to exceed $468,070.

 

 

DISCUSSION

 

Background

 

The City is responsible for the maintenance of 66 parks, seven pools, and eight splashpads, including the fountain at WPEC. The WPEC Fountain is open for public use from the Saturday of Memorial Day weekend through Labor Day (Attachment A). The Fountain has an electronic ultraviolet bacterial sterilizing light, a chemical control system, and a computer-controlled filtration and display pump system. The Fountain requires maintenance twice a day during summer months, and at least once a week during winter months, by an experienced pool maintenance contractor with specialized skills to monitor and maintain the sophisticated system.

 

Present Situation

 

On October 30, 2025, the City advertised an RFP for the WPEC Fountain Maintenance, Project No. OM-26-003. On December 3, 2025, two proposals were received from the following:

 

                     All Seasons Pool Service (Lodi, CA)

                     Pacific Water Art, Inc. (Santa Clara, CA)

 

A Selection Committee comprised of Public Works’ staff evaluated and ranked both proposals based on each company’s experience with similar kinds of work, quality of work, references, and understanding of the project. All Seasons Pool Service received the highest ranking, based on the noted criteria, and was determined to be the most qualified for this project.

 

It is recommended that Council approve a motion authorizing the City Manager to execute a three-year Service Contract, in the amount not to exceed $241,848, with All Seasons Pool Service (Attachment B). This Service Contract contains renewal options for up to two one-year extensions at $113,111 each, for a cumulative contract total not to exceed $468,070.

 

Findings

 

Pursuant to Stockton Municipal Code (SMC) section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. These findings include:

 

1.                     The Service Contract for WPEC Fountain Maintenance involves specialized requests requiring an experienced, qualified contractor who has successfully provided services of similar frequency and scope.

 

2.                     The City does not have the internal resources to perform the work required for this project.

 

3.                     Use of the RFP process is appropriate for this Service Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of the criteria helps ensure the selection of a vendor that will provide professional, responsive, and timely service which is in the public interest.

 

 

 

4.                     The City negotiated a contract following the solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.

 

FINANCIAL SUMMARY

 

There are sufficient funds available in the Public Works Parks Equipment Maintenance General Fund Account, in the amount of $80,616, to fund the first year of the Service Contract. Funding for the remaining years of the Service Contract will be contingent on future annual budget appropriations.
