ADOPT RESOLUTION TO AUTHORIZE THE GUARDRAIL REHABILITATION PROJECT

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Appropriate State Highway Safety Improvement Program funding in the amount of $307,300 to the Guardrail Rehabilitation, Project No. WT22049/HSIPSL-5008(198).
2. Approve Notice of Exemption No. NOE36-23 under the California Environmental Quality Act for the Guardrail Rehabilitation, Project No. WT22049/HSIPSL-5008(198).
3. Approve the plans and specifications for the Guardrail Rehabilitation, Project No. WT22049/HSIPSL-5008(198).
4. Award a Construction Contract in the amount of $268,975 to Midstate Barrier, Inc. of Stockton, CA, for the Guardrail Rehabilitation, Project No. WT22049/HSIPSL-5008(198).
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
The Guardrail Rehabilitation project will replace guardrail sections, posts, and terminals on Lower Sacramento Road just south of Bear Creek and on the West 99 Frontage Road at Mosher Slough bridge crossing just south of the Stockton Soccer Complex (Attachment A). The project is funded from the State Highway Safety Improvement Program (HSIP) and was included in the 2021-26 Five-Year Capital Improvement Plan (CIP).
On August 15, 2024, the City received one bid for this project. It is recommended that Council award a Construction Contract to the sole responsible bidder, Midstate Barrier, Inc., in the amount of $268,975. It is also recommended that Council adopt a resolution approving Notice of Exemption No. NOE36-23 under the California Environmental Quality Act (CEQA) and approving the plans and specifications for the project. Construction is anticipated to be completed by winter 2024.
DISCUSSION
Background
The HSIP is a core State-aid program that provides funding for projects that aim to reduce the frequency and severity of collisions by improving roadway design and operational conditions. In November 2020, the City submitted nine grant applications to Caltrans for Cycle 10 of the HSIP grant program, including the Guardrail Rehabilitation project. The project was awarded $374,200 in HSIP State funds, and there is no required local match. The project was included in the FY 2021-26 Five-Year CIP.
The project will enhance safety by replacing guardrail sections, posts, and terminals on Lower Sacramento Road just south of Bear Creek and on the West 99 Frontage Road at Mosher Slough bridge crossing just south of the Stockton Soccer Complex (Attachment A). There are currently damaged guardrail systems at both locations.
State and federal funding programs prohibit the use of the Local Employment Ordinance (Stockton Municipal Code (SMC) section 3.68.095), and the Local Business Preference Ordinance (SMC section 3.68.090).
Present Situation
On July 19, 2024, the Guardrail Rehabilitation, Project No. WT22049/HSIPSL-5008(198), was advertised for bids. On August 15, 2024, one bid was received with the following result:

The bid from Midstate Barrier, Inc., the sole responsible bidder, is regular in all respects and has the proper license to perform the work. It is recommended that Council approve the plans and specifications for the project and award a Construction Contract to Midstate Barrier, Inc. of Stockton, CA, in the amount of $268,975.
The project is in conformance with the City’s General Plan, pursuant to California Government Code, section 65402, and is categorically exempt from the requirements of CEQA as specified under Section 15301(d) of the CEQA Guidelines. The activities related to this project constitute a discretionary project under the City’s jurisdiction and qualifies as a project that does not have a significant effect on the environment. The resolution will approve the filing of Notice of Exemption No. NOE36-23 under CEQA.
Construction is anticipated to be completed by winter 2024.
FINANCIAL SUMMARY
With the appropriation of State HSIP funds in the amount of $307,300, there will be sufficient funding to award a Construction Contract to Midstate Barrier, Inc., in the amount of $268,975, for the Guardrail Rehabilitation, Project No. WT22049/HSIPSL-5008(198), and to fund all other construction related costs to complete the project.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended action.
