RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to authorize a reimbursement agreement with KB Home North Bay, LLC, (KB Home) in the estimated amount of $691,770 for the construction and installation of the Pock Lane sewer trunk main.

 

It is further recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of the resolution.

Summary

 

Capital Improvement Project UW18024, Ralph Avenue Sewer Trunk Line Rehabilitation, Phase II, intends to rehabilitate and address the deficiencies of an existing 30-inch diameter sewer trunk main on Pock Lane. A portion of the sewer pipe is within KB Home’s new subdivision, Pock Lane Unit 2 Improvements.

 

If approved by the City Council, the reimbursement agreement with KB Home (Exhibit 1 to the Resolution) will provide the most expeditious method to complete the construction and installation of this section of 30-inch sewer trunk main along Loomis Road.

 

DISCUSSION

 

Background

 

On May 14, 2024, the City Council approved the Ralph Avenue Sewer Trunk Line Rehabilitation, Phase II, Project UW18024 (Project) to address pipe failure and to evaluate other underlying deficiencies.

 

Through this Project, staff will rehabilitate and address the deficiencies of approximately 8,800 linear feet of existing 30-inch diameter sewer trunk main along Ralph Avenue from B Street to Pock Lane, along Pock Lane from Ralph Avenue to Loomis Road, and along Loomis Road from Pock Lane to Mariposa Road east of State Route 99 (Attachment A).

 

KB Home has proposed to relocate a section of the existing 30-inch sewer trunk main to the proposed Loomis Road to avoid a new stormwater drainage basin intended for the planned residential development. This segment of sewer pipe falls within the project area of Project UW18024, and funding this work will help facilitate the reconstruction of the deficient pipe and reduce the overall scope of work for Project UW18024.

 

Present Situation

 

The improvements are proposed to be constructed through a reimbursement agreement with KB Home, which has the knowledge and experience necessary to prepare plans and specifications for the design, construction, and installation of the improvements consistent with review and approval by the City Engineer. KB Home will select a contractor through a competitive bidding process before proceeding with construction and installation of the improvements.

 

The following project costs are eligible for reimbursement by the Department, which shall be based on actual costs incurred:

The Sewer Improvements in Pock Lane Unit 2 subdivision are anticipated to be completed in 2026.

 

Local Employment Ordinance

 

The contract amount is over $100,000 and subject to the City’s Local Employment Ordinance (Stockton Municipal Code Section 3.68.095), which requires that “all City contracts for public works or improvements of the estimated value or City subsidy of $100,000 or more shall contain provisions pursuant to which the contractor promises to make a good faith effort, with the assistance of local labor union hiring halls or community organizations designated by the City to employ qualified individuals who are, and have been for one year prior to the effective date of the contract, residents of Stockton in sufficient numbers so that no less than 50 percent of the contractor’s total construction workforce, including any subcontractor workforce, measured in labor work hours, is comprised of Stockton residents.” This requirement is included in the reimbursement agreement.

 

Environmental Clearance

 

According to the California Environmental Quality Act (CEQA) Section 15061, the proposed monetary agreement defines financial payments for sewer construction associated with the previously approved Pock Lane Unit 2 project (SCH: 2020090561) and does not constitute a new project or result in a physical change to the environment.

 

Also, following CEQA Section 15162, the construction work addressed in the agreement will not result in new construction or changes to the certified Environmental Impact Reports (EIRs) for that project. Accordingly, no further environmental review is required under CEQA Sections 15061(b)(3) (Common Sense Exemption) and 15162 (Subsequent EIRs and Negative Declarations).

 

FINANCIAL SUMMARY

 

Funds are available in the Wastewater Project UW18024 Ralph Avenue Sewer Trunk Line Rehabilitation, Phase II, account number 6518-000-800007-610-612-00-65-000-000.

 

This action has no impact on the General Fund, or any other unrestricted funds.
