ADOPT RESOLUTION TO AUTHORIZE THE SIDEWALK, CURB, AND GUTTER REPAIR PROGRAM FY 2019-20 SB1 PROJECT

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Approve Notice of Exemption No. NOE23-20 under the California Environmental Quality Act for the Sidewalk, Curb, and Gutter Repair Program FY 2019-20 SB1, Project No. PW1915.
2. Approve the plans and specifications for the Sidewalk, Curb, and Gutter Repair Program FY 2019-20 SB1, Project No. PW1915.
3. Award a Construction Contract in the amount of $1,045,560 to FBD Vanguard Construction, Inc., of Livermore, CA, for the Sidewalk, Curb, and Gutter Repair Program FY 2019-20 SB1, Project No. PW1915.
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
The Sidewalk, Curb, and Gutter Repair Program FY 2019-20 SB1 project will remove and replace sidewalks, curbs, and gutters damaged by City-maintained tree roots at approximately 128 locations citywide (Attachments A and B), and will reduce the City’s current sidewalk replacement backlog. This project also includes replacing sidewalk at six locations along Harding Way, between Lincoln and El Dorado Streets, through separate available funding.
On June 11, 2020, the City received two bids for this project. Staff recommends award of the Construction Contract to the lowest responsive bidder, FBD Vanguard Construction, Inc., in the amount of $1,045,560. The award amount is for the combined total of the Base Bid amount of $909,600 for citywide locations, plus the Bid Alternate in the amount of $135,960 for locations along Harding Way. Staff also recommends that Council adopt a resolution approving Notice of Exemption No. NOE23-20 under the California Environmental Quality Act (CEQA) and approving the plans and specifications for the project. Construction is anticipated to begin early fall 2020 and be completed by December 2020, weather permitting.
DISCUSSION
Background
The City maintains approximately 760 centerline miles of streets, most of which contain curb, gutter, and sidewalk. Prior to 1968, the adjacent property owner was responsible for all maintenance of the curb, gutter, and sidewalk in accordance with the Streets and Highways Improvement Act of 1911.
In 1968, Council revised the Stockton Municipal Code (SMC) to assume responsibility for repairs to all curbs, gutters, and sidewalks in cases where the damage is caused by City-owned or controlled trees (prior SMC 12.04.040).
The City regularly receives requests to repair curbs, gutters, and sidewalks. Each request is evaluated to determine if the repair is a City responsibility. If repairs are warranted, the location is added to a database for future permanent repairs. For sidewalk locations that need immediate correction, temporary repair is made using asphalt concrete material to patch the displaced area to remove the tripping hazard. Permanent repairs are made as funding becomes available and are prioritized in chronological order based on the date of the original service request.
The Sidewalk, Curb, and Gutter Repair Program FY 2019-20 SB1 project was included in the FY 2019-24 CIP. The project will remove and replace sidewalks damaged by City-maintained tree roots at approximately 128 locations citywide (Attachments A and B). This scope of work is included in the Base Bid. Upon completion of this project, there will be approximately 1,000 curb, gutter, and sidewalk locations on the permanent repairs backlog list. This backlog list does not include locations where sidewalks are needed but do not currently exist. These locations are referred to as “sidewalk gaps,” and are addressed when grant funding is available.
This project also includes a Bid Alternate for replacing sidewalk at six locations along Harding Way, between Lincoln and El Dorado Streets. This work was requested by the Economic Development Department in conjunction with the Miracle Mile Improvement District to eliminate tripping hazards and/or replace damaged sidewalk. This scope of work is funded by Strong Neighborhood Initiative redevelopment bond loan proceeds.
On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CTWA). The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date. On July 16, 2019, by Motion No. 2019-07-16-1403, Council extended the CWTA term to August 25, 2024. The CWTA was applied to this project as the estimated construction cost is more than $1 million.
Present Situation
On May 12, 2020, the Sidewalk, Curb, and Gutter Repair Program FY 2019-20 SB1, Project No. PW1915 was advertised for bids.
On June 11, 2020, two bids were received with the following results:

The contract will be awarded based on the lowest base bid received. The requirements of SMC section 3.68.090, Local Business Preference, apply to this project. Tom Mayo Construction is located within City limits and is entitled to a five percent bid preference. Application of the Local Business Preference has no effect on the bid order. The Local Employment Ordinance, SMC section 3.68.095, also applies to this contract.
The bid from FBD Vanguard Construction, Inc., the lowest responsible bidder, is regular in all respects and has the proper license to perform the work. Staff recommends Council approve the plans and specifications for the project and award a Construction Contract to FBD Vanguard Construction, Inc. in the amount of $1,045,560.
The project is in conformance with the City’s General Plan, pursuant to California Government Code, section 65402, and is categorically exempt from the requirements of CEQA as specified under Section 15301(c) (Existing Facilities), of the CEQA Guidelines. The activities related to this project constitute a discretionary project under the City’s jurisdiction and qualifies as a project that does not have a significant effect on the environment. This resolution will approve the filing of Notice of Exemption No. NOE23-20 under CEQA. Construction is anticipated to begin early fall 2020 and be completed by December 2020, weather permitting.
FINANCIAL SUMMARY
Funding for the Base Bid in the amount of $909,600 is available from an apportionment of the Road Repair and Accountability Act of 2017 (SB1) the City receives from the State of California that was appropriated in the Sidewalk, Curb, and Gutter Repair Program FY 2019-20 SB1, Project No. PW1915 account no. 030-3079-640.
Funding is also available for the Bid Alternate in the amount of $135,960 from the Harding Way Corridor, Project No. PW1612 account no. 305-3020-640. The Harding Way Corridor project is funded from Strong Neighborhood Initiative redevelopment bond loan proceeds that were allocated by Resolution No. 2016-03-29-1505. Both sources provide sufficient funding to award a Construction Contract to FBD Vanguard Construction, Inc., in the total amount of $1,045,560.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
