APPROVE MOTION TO AUTHORIZE THE PACIFIC GAS AND ELECTRIC EXTENSION AGREEMENT FOR THE AQUATIC FACILITIES RENOVATIONS - VICTORY PARK POOL

RECOMMENDATION
It is recommended that the City Council approve a motion to approve and authorize the City Manager to execute the Gas and Electric Extension Agreement with Pacific Gas and Electric in the amount of $131,035.91, for electrical service upgrades for the Aquatic Facilities Renovations - Victory Park Pool, Project No. CR18020.
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary
Victory Park is located on the west side of Pershing Avenue between Acacia Street and Picardy Drive (Attachment A). The Aquatic Facilities Renovations - Victory Park Pool project will demolish the existing pool and restroom/mechanical building and replace it with a new pool, spray-ground, restroom/mechanical building, and parking lot. The existing basketball court will also be demolished, and a new one will be constructed east of the existing tennis ball court.
The project requires Pacific Gas and Electric (PG&E) to upgrade the existing electrical service. A Gas and Electrical Extension Agreement (Attachment B) needs to be executed for PG&E to start ordering the material necessary for the electrical upgrades. Staff recommends Council authorize the execution of the Gas and Electrical Extension Agreement. Construction of the Victory Park Pool began in November 2024 and is anticipated to be completed by summer 2025.
DISCUSSION
Background
Victory Park is located on the west side of Pershing Avenue between Acacia Street and Picardy Drive (Attachment A). Victory Park measures over 22 acres and includes the Haggin Museum and rose garden, a basketball court, baseball diamonds, tennis courts, a children’s playground, Fire Station No. 6, and a swimming pool. The current swimming pool has been closed since 2013 due to building code deficiencies and repairs exceeding replacement costs. The existing pool site will be demolished, and a new swimming pool, spray-ground, restroom/mechanical building, and parking lot will be constructed in its place. The existing basketball court will also be demolished, and a new one will be constructed east of the existing tennis ball court.
On May 24, 2022, by Motion No. 2022-05-24-1221, Council awarded a Professional Services Contract to Studio W Architects of Sacramento, CA, for design of the Aquatic Facilities Renovation and Replacement - Victory Park Pool, Project No CR18020. Final construction documents were completed in June 2024.
On June 4, 2024, by Motion No. 2024-06-04-1213, Council awarded a Professional Services Contract to Roebbelen Construction Management Services, Inc. for construction management services for the Aquatic Facilities Renovations - Victory Park Pool, Project No. CR18020.
On September 17, 2024, by Motion No. 2024-09-17-1206, Council awarded a construction contract to CWS Construction Group, Inc. of Novato, CA, for the Aquatic Facilities Renovations - Victory Park Pool, Project No. CR18020.
The Aquatic Facilities Renovations - Victory Park Pool project will require electrical service upgrades to accommodate the new pool facility, mechanical equipment, basketball court lighting, and pathway lighting at Victory Park. Consequently, PG&E requires the project to include the installation of necessary conduits, transformer pads, and pull boxes per PG&E standards. PG&E will complete the electrical service upgrade with a new transformer and energize the system.
Present Situation
PG&E has provided a Gas and Electrical Extension Agreement for their scope of work. PG&E offers two payment options for this type of project: the 10-year refundable advance option and the non-refundable 50 percent discount option. The 10-year refundable advanced option for electric is for development or subdivision projects and is not applicable to this project. Therefore, the 50 percent non-refundable option in the amount of $131,035.91 is applicable.
The Agreement amount is over $100,000 and requires City Council approval. Staff also recommends Council approve a motion to authorize the City Manager to execute the Gas and Electric Extension Agreement.
FINANCIAL SUMMARY
Sufficient funding is available in the Aquatic Facilities Renovations - Victory Park Pool, Project No. CR18020 to fund the Gas and Electric Extension Agreement with PG&E in the amount of $131,035.91.
There is no financial impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended action.
