Summary

Approval of the requested action allows new viable driveway access to an approved 4.98-acre project site for a commercial truck fueling station with car wash and convenience store located at 4850 S. State Route 99 E. Frontage Road (Attachment A - Vicinity Map). The property owner, GINI Company, LLC, is requesting the portion of the restricted access along the project site’s frontage be removed to fit in a thirty-foot (30’) driveway access to the project site. Staff reviewed the request and recommends relinquishing restricted access that enables driveway access from the public street.

DISCUSSION

Background

The project site located at 4850 S. State Route 99 E. Frontage Road is a 4.98-acre vacant lot designated as a commercial zone. The project site is approved to develop a commercial truck fueling station, consisting of seven truck fueling stations that can simultaneously serve 14 trucks, six fueling stations for passenger vehicles that can simultaneously serve 12 passenger vehicles, a carwash, and a 4,670 square foot convenience store.

A final subdivision map, recorded with the San Joaquin County Recorder, identified the access restriction along the east side of S. State Route 99 E. Frontage Road that included the frontage of the project site. Generally, the basis of the restriction was to keep driveways a safe distance away from intersections to ensure driveway turning movements do not conflict with turning movements at the nearby intersection and are not visually impaired by structures or roadway curves.

The Development Code changes in 2004 included specifications for driveway access and distances from intersections and obstructions that removed the practice of restricting access for individual parcels on subdivision maps and made it easier for city staff to review driveway access and consider development applications in accordance with Code standards.

Present Situation

The property owner, GINI Company, LLC, is requesting the City’s relinquishment of restricted access along the portion of S. State Route 99 E. Frontage Road to allow for a driveway access point that will better serve the mixed vehicle type needs at the site. A thirty-foot (30’) long strip within the restricted portion of the east side of S. State Route 99 E. Frontage Road is requested to be relinquished.

Staff reviewed the property owner’s request and recommended approval to allow the 30’ driveway access along S. State Route 99 E. Frontage Road Street to facilitate improved access point and on-site traffic circulation. A City Encroachment Permit will be required for the new driveway access to ensure construction is per city standards.

FINANCIAL SUMMARY

The owner has paid the appropriate application fee to process the relinquishment of restricted access. There will be no financial impact to the City if the requested action is approved.
