AWARD A CONSTRUCTION CONTRACT TO ROBERT BURNS CONSTRUCTION, INC. FOR THE SWENSON PARK NORTH PUMP STATION ACCESS ROAD REHABILITATION PROJECT - PROJECT NO. M16015

RECOMMENDATION
It is recommended that the City Council adopt a resolution authorizing the City Manager to:
1. Approve the plans and specifications for the Swenson Park North Pump Station Access Road Rehabilitation Project, Project No. M16015.
2. Award a Construction Contract in the amount of $179,954.56 to Robert Burns Construction, Inc. of Stockton, CA for the Swenson Park North Pump Station Access Road Rehabilitation, Project No. M16015 (Exhibit 1 to Resolution).
3. Approve the filing of Notice of Exemption No. CE022-16 under the California Environmental Quality Act (CEQA) for the Swenson Park North Pump Station Access Road Rehabilitation, Project No. M16015 (Exhibit 2 to Resolution).
4. Approve the appropriation of $179,954.56 from the Capital Improvement Program, Account No. 437-7785-670.20-62 (Municipal Wastewater Utility - Capital Improvement Program Wastewater - Sanitary Pump Station Rehabilitation).
It is further recommended that the City Manager be authorized to take appropriate actions to carry out the purpose and intent of this resolution.

Summary
As part of the FY 2016-2021 Capital Improvement Plan, the Swenson Park North Pump Station Access Road Rehabilitation Project will replace the existing access road which is beyond its lifecycle.
On November 3, 2016, the City received four bids for the Swenson Park North Pump Station Access Road Rehabilitation, Project No. M16015. The project is intended to rehabilitate the existing access road to the North Pump Station.
If approved, this action will authorize the award of a construction contract in the amount of $179,954.56 to the lowest responsive bidder, Robert Burns Construction, Inc. of Stockton, CA.
DISCUSSION
Background
The Municipal Utilities Department (MUD) operates and maintains the North wastewater pump station and the Bonniebrook storm water pump station, both located in the Swenson Park golf course on Alexandria Place. Access to the pump stations is provided through the golf course parking lot to an existing paved roadway.
The existing roadway exceeded its lifecycle, much of the pavement is broken and potholed, and there are tree roots pushing up through the roadway in several places. It is essential that the roadway be in serviceable condition to maintain access to these two vital pump stations. These improvements will ensure access to the pump stations is reliable and safe. This project is identified in the FY 2016-2021 Capital Improvement Plan as one of the Sanitary Pump Station Rehabilitation projects.
Present Situation
The Swenson Park North Pump Station Access Road Rehabilitation Project No. M16015 was advertised on September 9, 2016. A mandatory pre-bid conference was held on October 11, 2016, with seven prospective bidders in attendance. On Thursday, November 3, 2016, four bids were received with the following results:

The bid of Robert Burns Construction, Inc., the lowest responsive bidder, is regular in all respects. Robert Burns Construction, Inc. has the proper license to perform the work. Staff recommends awarding the Construction Contract to Robert Burns Construction, Inc. in the amount of $179,954.56.
LOCAL EMPLOYMENT ORDINANCE
Both the Local Employment Ordinance (Stockton Municipal Code section 3.68.095) and the Local Preference Ordinance (Stockton Municipal code section 3.68.090) apply to this contract.
ENVIRONMENTAL CLEARANCE
The project is in conformance with the City’s General Plan, pursuant to California Government Code, Section 65402, and is exempt from the requirements of California Environmental Quality Act (CEQA) as specified under Article 19, Section 15301, Class 1, of the CEQA Guidelines.
FINANCIAL SUMMARY
There are sufficient funds available in Account 437-7785-670 (CIP - Wastewater/Sanitary Pump Station Rehabilitation) to award this contract.
There is no impact to the City’s General Fund or to any other unrestricted fund as a result of taking the recommended actions.
