RECOMMENDATION

 

It is recommended that City Council adopt by resolution the proposed amendment to Chapter 3.04 of the Council Policy Manual regarding member removal from boards, committees, and commissions.

Summary

 

On July 28, 2025, the Council Legislation/Environmental Committee reviewed, provided direction and forwarded a recommendation that Council adopt changes to Chapter 3.04 of the Council Policy Manual. Those changes are presented for the full Council’s consideration.

 

DISCUSSION

 

Background

 

During the April 15, 2025, Council Legislation/Environmental Committee Meeting, proposed changes to Chapter 3.04 were discussed by the Committee and direction was received by staff.

 

Staff was directed to remove language in Chapter 3.04 that required the Councilmember to seek approval from a majority of Council to agendize for discussion a removal for consideration that must pass by a majority vote, provide options for an appeal process for members who have been removed, and provide clarity to the voluntary resignation process specifying the requirement of a signed letter to be submitted to the Clerk’s Office.

 

At the May 27, 2025, Committee meeting, Staff presented two options for proposed redlines.  The Committee chose Option 1 which included the changes requested at the April 15, 2025, Committee meeting absent a formal appeal process.  Staff was then directed to return language to the policy that allowed other Councilmembers to agendize removal of members who were not appointed by themselves and to include language directing the policy to Council Policy Manual Chapter 3.13 - Councilmember and Commissioner Conduct Policy.

 

Present Situation

 

On July 28, 2025, the Council Legislation/Environmental Committee members met and recommended forwarding the Council Policy 3.04 to the full Council for adoption (Attachment A).
