RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to: 

 

1.                     Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process;

 

2.                     Authorize the City Manager to execute a contract for specialized services from AECOM in the amount of $1,000,000;

 

It is also recommended that the City Council authorize the City Manager to take appropriate and necessary actions to carry out the purpose and intent of the resolution.

Summary

 

Staff seeks City Council approval to award a contract for specialized services to AECOM (“Consultant”). The consultant will lead the City of Stockton in the development of a new Comprehensive Climate Action & Adaptation Plan (CCAAP) while implementing the grant requirements of the Adaptation Planning Grant Program (APGP) Round 1, administered by the California Governor’s Office of Planning and Research (OPR), and the Climate Pollution Reduction Grant Planning (CPRGP) through the U.S EPA Region 9.

 

The APGP and CPRGP grants are funding the City’s efforts to build climate adaptation strategies and resiliency through planning, research and capacity building, restoration, and sustainable infrastructure to develop or update existing regional climate mitigation plans to address greenhouse gas and reduction measures throughout the Stockton Metropolitan Statistical Area (MSA) area. Specific activities will include updating plans to reduce climate pollution, completing a greenhouse gas inventory, quantifying greenhouse gas reduction measures, conducting a low income and disadvantaged communities benefit analysis, and stakeholder engagement.

 

DISCUSSION

 

Background

 

On December 12, 2023, City Council adopted Resolution No. 2023-12-12-1202, accepting the State of California APGP Grant Round 1 in the amount of $650,000. Subsequently, on May 14, 2024, City Council adopted Resolution No. 2024-5-14-1502 accepting the Federal CPRGP Grant in the amount of $1,000,000. Within these 2 grant awards, there is a total of $1,000,000 allocated for consulting services for climate action plan development.

 

The APGP grant and CPRGP grant will be used in combination to develop a new Comprehensive Climate Action & Adaptation (CCAAP) plan for the City which combines the requirements of both programs. These grants require key deliverables: a Climate Vulnerability and Risk Assessment, a Priority Climate Action Plan, a Comprehensive Climate Action Plan (due two years from the date of award), and a status report due at the close of the grant period.

 

On March 20, 2024 City staff posted a Request for Proposals (RFP) PUR 24-030 to identify a consultant to lead the development of this new Comprehensive Climate Action & Adaptation Plan (CCAAP). On May 2, 2024 City staff received 5 proposals in response to RFP PUR24-030.

 

Present Situation

 

After reviewing the 5 proposals received, City staff conducted interviews with all 5 consultant companies. A review panel consisting of staff from the Environmental & Sustainability Division, Public Works, Municipal Utilities, and Community Development Departments conducted the interviews. The review panel agreed that the company that would provide the best value and experience to develop the CCAAP is AECOM.

 

Findings

 

Pursuant to Stockton Municipal Code (SMC) section 3.68.070, the Council may approve findings which support and justify an exception to the competitive bidding process.

 

The following findings support such an exception:

 

1.                     Use of the RFP process is appropriate for this agreement because it relies on the evaluation of professional qualifications and performance as the basis for the selection of a vendor, which is a typical practice for this type of work.

 

2.                     The City negotiated the contract following the solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.

 

Staff recommends the City Council approve the findings and adopt a resolution authorizing the City Manager to execute a contract in the amount not to exceed $1,000,000.00 with AECOM to develop a Comprehensive Climate Action & Adaptation Plan (CCAAP) for the City of Stockton.

 

FINANCIAL SUMMARY

 

The base proposal amount is $979,340 with an additional $20,660 allocated as contingency amount, for a total contract amount of $1,000,000. The contract amount for specialized services will be exclusively funded by the previously approved and appropriated grant awards; $310,000 from the Adaptation Planning Grant Program (APGP) Round 1, and $690,000 from the Climate Pollution Reduction Grant Planning (CPRGP).  To establish the contract for specialized services, an appropriation of revenue and expenditures of $1,000,000 is necessary in the City Manager’s Special Grants Fund - Reimbursement, General Administration Division.

 

There will be no impact to the General Fund.
