RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Appropriate funds in the amount of $127,632.38 from the Stockton Consolidated Landscape Maintenance Assessment District No. 96-2 Reserves for Continuing Appropriations Accounts to Fong Park Phase II, Project No. WP13207.

 

2.                     Approve Notice of Exemption No. NOE11-23 under the California Environmental Quality Act for the Fong Park Phase II, Project No. WP13207.

 

3.                     Approve the plans and specifications for the Fong Park Phase II, Project No. WP13207.

 

4.                     Award a Construction Contract in the amount of $1,117,606 to McFadden Construction, Inc. of Stockton, CA, for the Fong Park Phase II, Project No. WP13207.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

Fong Park is located at 2408 Thistle Way and consists of approximately seven acres. Five of the seven acres of the neighborhood park site were developed in 2004, with water and utility connections extending to the remaining two undeveloped acres (Attachment A). The Fong Park Phase II project will improve the remaining two acres of the park site with the installation of concrete walkways, solar pathway lighting, waterwise landscaping, benches, and trash receptacles.  The project also includes converting the existing Phase I conventional sodium halide pathway lighting to all solar to match the Phase II improvements.  The project was included in the 2024-29 Five-Year Capital Improvement Plan (CIP) with project funding from Senate Bill (SB) 179.

 

On December 19, 2024, the City received six bids for this project.  It is recommended that Council award a Construction Contract to the lowest responsible bidder, McFadden Construction, in the amount of $1,117,606.  It is also recommended that Council adopt a resolution approving Notice of Exemption No. NOE11-23 under the California Environmental Quality Act (CEQA), approving the plans and specifications, and appropriating funds for the project. Construction is anticipated to begin in spring 2025 and be completed by winter 2025, weather permitting.

 

 

 

DISCUSSION

 

Background

 

Fong Park is located at 2408 Thistle Way and covers approximately seven acres.  The community around the Fong Park site was constructed in phases with the Blossom Ranch, River Bend, and Hunter Ridge developments.  Development of the area started in 1998 from Holman Road and progressed westward toward the Fong Park site.  Park site construction normally lags behind the progress of development until 50 to 70 percent of the homes are occupied and the need for a park is warranted.  The area north-east of the Fong Park site was substantially built out by the early 2000s, which triggered the need for a park.  However, homes and the roadway along the west perimeter of the park were not yet constructed and would likely take years to materialize.  Consequently, the design and construction of the park was divided in two phases to coincide with the construction of homes and roadways along the perimeter of the park site.   

 

The original master plan for the entire park site was prepared in 2000 (five-acre park).  Phase I of the master plan is the vast majority of park space and amenities, and included two half-court basketball courts, a playground, a group picnic area and overhead structure, benches, picnic tables, and lighted meandering concrete walkways.   Phase II, the remaining two-acres, only involves extending walkways and grass as needed when the remaining homes and roadway frontages are completed on the west side of the park. 

 

Fong Park Phase I began construction in March 2003, and the five-acre park site was opened to the public in July 2004.   The rest of the community housing and an elementary school west of the park site were fully built out by 2010.  Subsequently, staff retained an engineering firm and started design work and preparing plans and specifications for Fong Park Phase II.  Construction funding was also programmed in the 2010-15 Five-Year CIP.  Unfortunately, impacts of the “Great Recession” caused the City to initiate a reconciliation review of various projects funded through the Public Facility Fee (PFF) program, which included the Fong Park Phase II project.  The project was later put on hold because it was determined sufficient funding did not exist in the PFF program.  Many projects were canceled and/or placed on hold, which included Fong Park Phase II.   

 

Through the efforts of Senator Susan Talamantes Eggman, SB 179 enabled the City to obtain a portion of legislative funding directed to critical programs in California.  Stockton received a direct allocation of funding intended to strengthen recreational opportunities in Stockton’s aquatic and park facilities.  Specifically, Victory Park, McKinley Park, and Fong Park received funding.  Fong Park received $1,700,000 in State funding administered under the State Department of Parks and Recreation.  The City entered into a grant agreement with the State Department of Parks and Recreation in May 2023. 

 

By the end of 2023, the City contracted with Siegfried Engineering, Inc. to update the previous plans and specifications for the Fong Park Phase II project.  Fong Park Phase II design extends existing walkways, solar pathway lighting, waterwise landscaping, benches, and trash receptacles.  The project also includes converting the existing Phase I conventional sodium halide pathway lighting to all solar to match the Phase II improvements.  This portion of the project cost will be funded through the existing Stockton Consolidated Landscape Maintenance Assessment District No. 96-2.  The project was included in the 2024-29 Five-Year CIP.

 

On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA). The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date. On July 16, 2019, by Motion No. 2019-07-16-1403, Council extended the CWTA term to August 25, 2024. On August 20, 2024, by Motion No. 2024-08-20-1203, Council extended the CWTA term to August 25, 2029. The CWTA was applied to this project as the estimated construction cost is over $1 million.

 

Present Situation

 

On November 21, 2024, the Fong Park Phase II, Project No. WP13207, was advertised for bids. On December 19, 2024, six bids were received with the following results:

The requirements of Stockton Municipal Code (SMC) section 3.68.090, Local Business Preference, apply to this project. McFadden Construction, Inc. is located within San Joaquin County limits and is entitled to a two percent bid preference. Application of the Local Business Preference has no effect on the bid order. The Local Employment Ordinance, SMC section 3.68.095, also applies to this contract.

 

The base bid from McFadden Construction, Inc., the lowest responsible bidder, is regular in all respects and has the proper license to perform the work.  It is recommended that Council approve the plans and specifications, and award a Construction Contract to McFadden Construction, Inc. of Stockton, CA, in the amount of $1,117,606 for the Fong Park Phase II, Project No. WP13207.

 

The project is in conformance with the City’s General Plan, pursuant to California Government Code, section 65402, and is categorically exempt from the requirements of CEQA as specified under Section 15304(b) of the CEQA Guidelines. The activities related to this project constitute a discretionary project under the City’s jurisdiction and qualifies as a project that does not have a significant effect on the environment. The resolution will approve the filing of Notice of Exemption No. NOE11-23 under CEQA.

 

Construction is anticipated to begin in spring 2025 and be completed by winter 2025, weather permitting.

 

FINANCIAL SUMMARY

 

With the appropriation of funds in the amount of $127,632.38 from the Stockton Consolidated Landscape Maintenance Assessment District No. 96-2 Reserves for Continuing Appropriations Account to the Fong Park Phase II, Project. No. WP13207, there will be sufficient funds to award a Construction Contract to McFadden Construction, Inc. in the amount of $1,117,606.

 

There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
