ADOPT RESOLUTION TO AWARD A PROFESSIONAL SERVICES CONTRACT FOR THE DOWNTOWN STOCKTON WEBER AVENUE BIKE AND PEDESTRIAN CONNECTIVITY PROJECT

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Appropriate funds in the amount of $9,427,000 from the State Active Transportation Program to the Downtown Stockton Weber Avenue Bike and Pedestrian Connectivity, Project No. WT24038/ATPSB1L-5008(206).
2. Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.
3. Award a Professional Services Contract to R.E.Y. Engineers, Inc. of Folsom, CA, in the amount of $1,412,881.13 for design of the Downtown Stockton Weber Avenue Bike and Pedestrian Connectivity, Project No. WT24038/ATPSB1L-5008(206).
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
Public Works was successful in receiving $9,427,000 in Regional Active Transportation Program (ATP) funds for the Downtown Stockton Weber Avenue Bike and Pedestrian Connectivity, Project No. WT24038/ATPSB1L-5008(206). The project will construct bike facilities and pedestrian improvements along Weber Avenue from Washington Street to Wilson Way (Attachment A). The project will also upgrade curb ramps to current Americans with Disabilities Act (ADA) standards, install Class IV bike lanes, rectangular rapid flashing beacons (RRFB), crosswalks, signal timing improvements, bike storage, bike lockers, public art, trees, new signage, sidewalk improvements, and curb and gutter.
On January 17, 2025, the City advertised a Request for Proposals (RFP) for design of the Downtown Stockton Weber Avenue Bike and Pedestrian Connectivity, Project No. WT24038/ATPSB1L-5008(206). On February 26, 2025, four firms submitted proposals for this project. The Selection Committee evaluated the proposals and found R.E.Y. Engineers, Inc. of Folsom, CA, to be the most qualified firm for this project.
It is recommended that Council adopt a resolution appropriating funds and authorizing the City Manager to execute a Professional Services Contract in the amount of $1,412,881.13 with R.E.Y. Engineers, Inc. for design services. It is anticipated that the design will be completed by fall 2026.
DISCUSSION
Background
Federal and State ATP funds are available for projects that encourage increased use of active modes of transportation such as walking and bicycling. In 2022, Public Works submitted the Downtown Stockton Weber Avenue Bike and Pedestrian Connectivity project grant application for the ATP Cycle 6 program. The project was awarded $9,427,000 in Regional ATP funds (State funds only). The project was identified in the Greater Downtown Stockton ATP.
The project will construct bike facilities and pedestrian improvements along Weber Avenue from Washington Street to Wilson Way (Attachment A). The project will also upgrade curb ramps to current ADA standards, install Class IV bike lanes, RRFB, crosswalks, signal timing improvements, bike storage, bike lockers, public art, trees, new signage, sidewalk improvements, and curb and gutter.
Present Situation
On January 17, 2025, the City advertised an RFP for design of the Downtown Stockton Weber Avenue Bike and Pedestrian Connectivity, Project No. WT24038/ATPSB1L-5008(206). On February 26, 2025, four proposals were received from the following firms:
• CSG Consultants (Sacramento, CA)
• Kimley-Horn (Sacramento, CA)
• R.E.Y. Engineers, Inc. (Folsom, CA)
• Siegfried Engineering, Inc. (Stockton, CA)
The Selection Committee evaluated and ranked all proposals based on each firm’s understanding of work, experience with similar kinds of projects, staff qualifications, capability of developing innovative or advanced techniques, familiarity with State and federal procedures, financial responsibility, and demonstrated technical ability.
R.E.Y. Engineers, Inc. received the highest ranking, based on the noted criteria, and was determined to be the most qualified firm for this project. Staff negotiated a fee in the amount of $1,412,881.13 with R.E.Y. Engineers, Inc. for design services. The fee is approximately 15 percent of the estimated construction cost, which is reasonable for a project of this size and complexity.
It is recommended that Council adopt a resolution appropriating funds and authorizing the City Manager to execute a Professional Services Contract to R.E.Y. Engineers, Inc. in the amount of $1,412,881.13 for design services for the Downtown Stockton Weber Avenue Bike and Pedestrian Connectivity, Project No. WT24038/ATPSB1L-5008(206). It is anticipated that the design will be completed by fall 2026.
Findings
Pursuant to Stockton Municipal Code (SMC) section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. These findings include:
1. The City does not have sufficient staff and expertise to design this project.
2. Use of the RFP process is appropriate for this Professional Services Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of the criteria helps ensure selection of a vendor that will provide the highest quality professional service, which is in the public interest.
3. The City negotiated a contract following solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.
FINANCIAL SUMMARY
With the appropriation of funds in the amount of $9,427,000 from the State Active Transportation Program to the Downtown Stockton Weber Avenue Bike and Pedestrian Connectivity, Project No. WT24038/ATPSB1L-5008(206), there will be sufficient funding to award a Professional Services Contract to R.E.Y. Engineers, Inc. for the project.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
