ADOPT A RESOLUTION TO AUTHORIZE A CONTRACT WITH STORM WATER INSPECTION AND MAINTENANCE SERVICES, LLC FOR UNDERGROUND STORMWATER TREATMENT DEVICES

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Authorize a three (3) year contract with Storm Water Inspection and Maintenance Services, LLC (SWIMS) of Discovery Bay, CA, for inspection and maintenance of underground stormwater treatment devices with a not-to-exceed amount of $479,985.
2. Authorize the City Manager to execute two (2) additional one (1) year contract extensions with Storm Water Inspection and Maintenance Services, LLC of Discovery Bay, CA.
It is also recommended that the Interim City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
The Municipal Utilities Department (MUD) is comprised of three enterprise funds including Water, Wastewater, and Stormwater Utilities. The Stormwater Utility consists of 77 pump stations, more than 600 miles of pipeline, and 22,500 drain inlets that route stormwater from city streets into local basins and waterways. The Stormwater Utility is also responsible for oversight and compliance with the National Pollutant Discharge Elimination System (NPDES) permit for Municipal Separate Storm Sewer Systems, held collectively with the San Joaquin County. This permit regulates municipal stormwater discharges and requires extensive monitoring and public outreach programs to promote water quality in the San Joaquin Delta.
If approved, this action will authorize a three (3) year contract with SWIMS to perform inspection and maintenance services of underground stormwater treatment devices in the City (Exhibit 1 to the resolution) with a not-to-exceed amount of $479,985.
DISCUSSION
Background
There are underground stormwater treatment devices at various locations throughout Stockton. These devices filter out pollutants from urban stormwater runoff such as debris, particulate matter, sediments, and petroleum products before these materials are discharged into local waterways. Regular maintenance of these treatment devices is necessary to maintain proper function and compliance with the NPDES permit.
The Stormwater Utility has identified 13 underground stormwater treatment devices whose maintenance require specialized equipment and expertise due to system design and access constraints. To ensure proper function, reduce flooding from storm runoff, and improve water quality, it will be required to secure the services of a qualified contractor for the routine inspection and maintenance of these devices.
This approach has been determined to be the most cost-efficient and practical solution to maintain device functionality and compliance with local, state, and federal stormwater regulations.
Present Situation
On August 1, 2024, MUD staff advertised a Request for Sealed Bids for the Inspection and Maintenance of Underground Stormwater Treatment Devices, Project No. PUR 25-005.
On September 12, 2024, the City received the following two sealed bids:

SWIMS submitted the lowest bid, which satisfied all required specifications. If awarded, this contract will ensure timely inspection and maintenance services, reduce the risk of stormwater pollution to local waterways caused by urban runoff, and fulfill permit requirements.
Staff recommend that the City Council adopt a resolution to award SWIMS with a three (3) year contract for the inspection and maintenance of underground stormwater treatment devices with a not-to-exceed amount of $479,985, with an option to extend the contract for two (2) additional one (1) year terms.
FINANCIAL SUMMARY
Funds will be budgeted in the Stormwater Collections account for FY 2025-26 to cover the first year of the contract. The annual cost is $159,995, and the three (3) year not-to-exceed amount is $479,985. The contract cost includes all labor, equipment, and disposal fees associated with cleaning and filter cartridge replacement.
Funds for future services will be budgeted in the same accounts in subsequent fiscal years and presented to the City Council for approval through the annual budget development process.
There is no impact on the General Fund or any other unrestricted fund, from this action.
