ADOPT RESOLUTION TO AUTHORIZE THE NORTH PERSHING AVENUE SAFETY ENHANCEMENTS PROJECT

RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Appropriate Highway Safety Improvement Program funds in the amount of $75,600 to the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197).

 

2.                     Approve Notice of Exemption No. NOE51-23 under the California Environmental Quality Act for the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197).

 

3.                     Approve the plans and specifications for the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197).

 

4.                     Authorize Professional Services Contract Amendment No. 1 in the amount of $18,880 with CSG Consultants of Foster City, CA, for additional design services for the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197).

 

5.                     Award a Construction Contract in the amount of $586,595.20 to Quimu Contracting, Inc. of Dixon, CA, for the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197).

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The North Pershing Avenue Safety Enhancements project will improve safety at the intersections of North Pershing Avenue and Rosemarie Lane, and North Pershing Avenue and Country Club Boulevard.  The project will add protected left turn signal phasing, lengthen existing turn pockets, and upgrade signal equipment (Attachment A).  The project is funded by the Highway Safety Improvement Program (HSIP) and was included in the 2025-30 Five-Year Capital Improvement Plan (CIP).

 

On July 17, 2025, the City received seven bids for this project.  It is recommended that Council award a Construction Contract to the lowest responsible bidder, Quimu Contracting, Inc., in the amount of $586,595.20. It is also recommended that Council adopt a resolution approving Notice of Exemption No. NOE51-23 under the California Environmental Quality Act (CEQA) and approving the plans and specifications for the project.  Construction is anticipated to be completed by summer 2026.

 

On August 19, 2022, the City Manager authorized a Professional Services Contract, in the amount of $90,515, to CSG Consultants of Foster City, CA, for design services for the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197).  Professional Services Contract Amendment No. 1 is needed for additional design services during construction.  It is recommended that Council adopt a resolution to authorize Professional Services Contract Amendment No. 1 in the amount of $18,880 with CSG Consultants for additional design services during construction.  It is also recommended that Council appropriate HSIP funds in the amount of $75,600 to the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197).

 

DISCUSSION

 

Background

 

The HSIP is a core federal-aid program established to achieve a significant reduction in fatalities and serious injuries on all public roads. Caltrans, Division of Local Assistance, manages California's local agency share of HSIP funds. HSIP focuses on infrastructure projects with nationally recognized crash reduction factors. Local HSIP projects are prioritized based on crash experience, benefit from counter measures, or other data-supported means.

 

In November 2020, the City submitted nine grant applications to Caltrans for Cycle 10 of the HSIP grant program, including the North Pershing Avenue Safety Enhancements project. The project was awarded a total of $721,200 in State Cycle 10 HSIP funds to cover the design and construction of the project, and there is no required local match. The project will add protected left turn signal phasing, lengthen existing turn pockets, and upgrade signal equipment to improve safety at the intersections of North Pershing Avenue and Rosemarie Lane, and North Pershing Avenue and Country Club Boulevard.

 

The project was included in the 2025-30 Five-Year CIP. The HSIP grant approved $586,900 for construction.  Estimates based on detailed design indicated this construction funding was insufficient and staff requested an additional $75,600 from Caltrans.  Caltrans approved the requested amount, bringing the total programed construction funding for the project to $662,500.

 

On August 19, 2022, the City Manager authorized a Professional Services Contract, in the amount of $90,515, to CSG Consultants of Foster City, CA, for design services for the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197).  During project design, unforeseen field conditions and complications with constructability of Americans with Disabilities Act compliant wheelchair ramps required additional engineering work from the design consultant.  Professional Services Contract Amendment No. 1 in the amount of $18,880 is needed to compensate CSG Consultants for final expenses to complete the design work. 

 

On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA). The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date. On July 16, 2019, by Motion No. 2019-07-16-1403, Council extended the CWTA term to August 25, 2024.  On August 20, 2024, by Motion No. 2024-08-20-1203, Council extended the CWTA term to August 25, 2029. The CWTA was not applied to this project as the estimated construction cost was less than $1 million.

 

Present Situation

 

On June 17, 2025, the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197), was advertised for bids. On July 17, 2025, seven bids were received with the following results:

State and federal funding programs prohibit the use of the Local Employment Ordinance, Stockton Municipal Code (SMC) section 3.68.095, and the Local Business Preference Ordinance, SMC section 3.68.090.

 

Quimu Contracting, Inc. is the lowest responsible bidder and has the proper license to perform the work.  It is recommended that Council approve the plans and specifications, and award a Construction Contract to Quimu Contracting, Inc. of Dixon, CA, in the amount of $586,595.20, for the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197).

 

The project is in conformance with the City’s General Plan, pursuant to California Government Code, section 65402, and is categorically exempt from the requirements of CEQA as specified under Section 15301(c) of the CEQA Guidelines. The activities related to this project constitute a discretionary project under the City’s jurisdiction and qualifies as a project that does not have a significant effect on the environment. The resolution will approve the filing of Notice of Exemption No. NOE51-23 under CEQA.  Construction is anticipated to be completed by summer 2026.

 

It is also recommended that Council adopt a resolution to authorize Professional Services Contract Amendment No. 1 in the amount of $18,880 with CSG Consultants for additional design services for the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197).  Professional Services Contract Amendment No. 1 requires Council authorization as the cumulative amount exceeds the administrative amendment authority allowed under the existing contract.  The total revised contract value will be $109,395.

 

FINANCIAL SUMMARY

 

With the appropriation of HSIP funds in the amount of $75,600 to the North Pershing Avenue Safety Enhancements, Project No. WT22047/State Project No. HSIPSL-5008(197), there will be sufficient funds to authorize Professional Services Contract Amendment No. 1 in the amount of $18,880 with CSG Consultants, award a Construction Contract in the amount of $586,595.20 to Quimu Contracting, Inc., and to fund all other construction related costs to complete the project.

 

There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
