ADOPT RESOLUTION TO AUTHORIZE ON-CALL CONCRETE SAW-CUTTING AND SHAVING SERVICES

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Approve Notice of Exemption No. NOE40-24 under the California Environmental Quality Act for On-Call Concrete Saw-Cutting and Shaving Services, Project No. WD23004.
2. Award a three-year Service Contract, in the amount not to exceed $150,000, to Precision Emprise, LLC dba Precision Concrete Cutting of Oakland, CA, for On-Call Concrete Saw-Cutting and Shaving Services, Project No. WD23004.
3. Authorize the City Manager to execute up to two one-year extensions to this Service Contract, at an annual cost not to exceed $50,000, for a cumulative contract total not to exceed $250,000.
4. Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
Concrete sidewalks throughout the City have been lifted by tree roots to create a vertical displacement at the sidewalk joint. In some cases, the displacement can be eliminated by cutting the elevated sidewalk panel down to the level of the adjacent panel. The On-Call Concrete Saw-Cutting and Shaving Services project will eliminate such displacements throughout the City.
On July 15, 2024, the City advertised a Request for Proposals (RFP) for On-Call Concrete Saw-Cutting and Shaving Services, Project No. WD23004. On August 5, 2024, two firms submitted proposals for this project. The Selection Committee evaluated the proposals and found Precision Emprise, LLC dba Precision Concrete Cutting (Precision) of Oakland, CA, to be the most qualified and highest ranked firm.
It is recommended that Council adopt a resolution authorizing the City Manager to execute a three-year Service Contract, in the amount not to exceed $150,000, with Precision. This Service Contract contains renewal options for up to two one-year extensions of $50,000 each and a cumulative contract total not to exceed $250,000. It is also recommended that Council adopt a resolution approving Notice of Exemption No. NOE40-24 under the California Environmental Quality Act (CEQA).
DISCUSSION
Background
The City maintains approximately 781 centerline miles of streets, most of which contain curbs, gutters, and sidewalks. Prior to 1968, the adjacent property owner was responsible for maintenance of all curbs, gutters, and sidewalks in accordance with the Streets and Highways Improvement Act of 1911. In 1968, Council revised the Stockton Municipal Code (SMC) to assume responsibility for repairs to all curbs, gutters, and sidewalks in cases where the damage is caused by City-owned or controlled trees (SMC 12.04.040(B)).
The City regularly receives requests to repair curbs, gutters, and sidewalks. Each request is evaluated to determine if repair is needed and if the damage is caused by a City tree. If the repairs are warranted, the sidewalk location is added to a database for future permanent repairs. Permanent repairs are made as funding becomes available and are prioritized in chronological order based on the date of the original service request.
If practical, a temporary repair is made, typically using asphalt concrete material to patch the displaced area. Concrete saw-cutting and shaving is an alternative repair method that can be applied at locations with vertical displacements that are less than two inches. The work is done with a hand-held, electrically powered diamond blade saw that cuts the raised sidewalk from edge to edge, tapering the concrete to match adjacent level surfaces. Compared to repair using asphalt concrete, concrete saw-cutting provides improved conditions for pedestrians and a more attractive finish. In addition, the saw-cutting method can potentially eliminate, or at least delay, the need for permanent replacement. The City does not have the internal resources to perform this type of repair method.
Staff anticipates that the On-Call Concrete Saw-Cutting and Shaving Services project will repair approximately 350 locations annually. Currently, 1,700 sidewalk repair locations have been reported or identified.
Present Situation
On July 15, 2024, the City advertised an RFP for On-Call Concrete Saw-Cutting and Shaving Services, Project No. WD23004. On August 5, 2024, two proposals were received from the following:
• Precision Emprise, LLC dba Precision Concrete Cutting (Oakland, CA)
• Trip Stop Sidewalk Repair, Inc. (San Carlos, CA)
A Selection Committee comprised of Public Works’ staff evaluated and ranked both proposals based on each firm’s experience, qualifications of staff, quality control, and cost. Precision received the highest ranking, based on the noted criteria, and was determined to be the most qualified firm for this project.
It is recommended that Council adopt a resolution authorizing the City Manager to execute a three-year Service Contract, in the amount not to exceed $150,000, with Precision of Oakland, CA, for On-Call Concrete Saw-Cutting and Shaving Services, Project No. WD23004. Payment will be based on actual work performed at the negotiated unit price, with field verification by City staff. Initial contracted services will expire on December 31, 2027. The City has the option to initiate two one-year extensions thereafter, at an annual cost of $50,000, for a cumulative contract total not to exceed $250,000.
The project conforms with the City’s General Plan, pursuant to California Government Code section 65402, and is categorically exempt from the requirements of CEQA as specified under Section 15301(c) of the CEQA Guidelines. As a result, the project has been granted a categorical exemption. The activities related to this project constitute a discretionary project under the City’s jurisdiction and qualifies as a project that does not have a significant effect on the environment. The resolution will approve the filing of Notice of Exemption No. NOE40-24 under CEQA.
Findings
Pursuant to SMC section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. These findings include:
1. The City does not have the internal resources to perform concrete saw-cutting and shaving services.
2. Concrete saw-cutting and shaving involves specialized equipment (diamond blade saw) and work that requires an experienced, qualified contractor who has successfully provided services of similar frequency and scope.
3. Use of the RFP process is appropriate for this Service Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of the criteria helps ensure selection of a vendor that will provide professional, responsive, and timely service which is in the public interest.
4. The City negotiated a contract following solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.
FINANCIAL SUMMARY
There are sufficient funds in Project No. WD23004 to award a Service Contract for On-Call Concrete Saw-Cutting and Shaving Services, Project No. WD23004, to Precision of Oakland, CA, in the amount of $150,000.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
