AWARD A CONSTRUCTION CONTRACT TO MOZINGO CONSTRUCTION, INC. FOR THE 2014 SANITARY SEWER REHABILITATION PROJECT, PHASE 1 (PROJECT NO. M14006)

RECOMMENDATION
It is recommended that the City Council adopt a resolution authorizing the City Manager to:
1. Approve the filing of Notice of Exemption No. CE001-16 under the California Environmental Quality Act (CEQA) for the 2014 Sanitary Sewer Rehabilitation Project, Phase 1 (Project No. M14006).
2. Adopt the plans and specifications for the 2014 Sanitary Sewer Rehabilitation Project, Phase 1 (Project No. M14006).
3. Award a Construction Contract in the amount of $572,885 to Mozingo Construction, Inc., of Oakdale, CA, for the 2014 Sanitary Sewer Rehabilitation Project, Phase 1 (Project No. M14006).
It is further recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
The 2014 Sanitary Sewer Rehabilitation Project, Phase 1 will rehabilitate various existing sewer lines throughout the City of Stockton. This project is part of an ongoing annual program to address concerns over certain sewer line conditions, inadequate sizing, and the potential for pipe failure.
On August 27, 2015, the City received one bid for construction of the 2014 Sanitary Sewer Rehabilitation project. The bid was 25 percent over the Engineer’s Estimate (Base Bid). On December 8, 2015, Council adopted a resolution rejecting the bid. The project plans were subsequently split into two phases for rebidding.
On April 7, 2016, the City received five bids for the 2014 Sanitary Sewer Rehabilitation Project, Phase 1 (Project No. M14006). The recommended resolution will approve the plans and specifications for the project and award a Construction Contract to the lowest responsible bidder, Mozingo Construction, Inc., in the amount of $572,885 for the construction of the 2014 Sanitary Sewer Rehabilitation Project, Phase 1. The resolution will also approve the filing of Notice of Exemption No. CE001-16 under CEQA. Construction is anticipated to be completed by December 2016.
DISCUSSION
Background
The City has an ongoing annual capital program to rehabilitate deteriorated and under-sized sanitary sewer lines. The 2014 Sanitary Sewer Rehabilitation Project was designed and placed out to bid in the summer of 2015. On August 27, 2015, the City received one bid for construction of the 2014 Sanitary Sewer Rehabilitation Project. The bid was 25 percent over the Engineer’s Estimate (Base Bid). On December 8, 2015, Council adopted Resolution No. 15-2119, rejecting all bids received for the construction of the 2014 Sanitary Sewer Rehabilitation Project. The project was subsequently split into two phases for rebidding. Phase 1 consists of lines that need to be constructed by an open cut trench method. Phase 2, to be bid at a later date, will consist of cured-in-place or other specialized pipe rehabilitation methods. This change was made to encourage more bidders.
The Phase 1 project includes the replacement of approximately 1,831-feet of existing six-inch sewer line by open cut throughout the City of Stockton. The construction will replace pipes along California Street between Eighth Street and Ninth Street; Wilson Way between Dr. Martin Luther King Jr. Boulevard; Channel Street between Sutter Street and California Street; Acacia Street between Harrison Street and Lincoln Street; and Lincoln Street between Acacia Street and Magnolia Street (Attachment A).

On April 7, 2016, five bids were received for the 2014 Sanitary Sewer Rehabilitation Project, Phase 1 (Project No. M14006) with the following results:

The Local Employment Ordinance (SMC, Section 3.68.095) applies to this contract. This ordinance requires the contractor “to make a good faith effort … to employ qualified individuals who are, and have been for one year prior to the effective date of the contract, residents of Stockton in sufficient numbers so that no less than 50 percent of the contractor’s total construction work force, including subcontractor work force, measured in labor work hours, is comprised of Stockton residents.” The Contractors who fail to achieve the 50 percent goal must demonstrate that they made a good faith effort to do so, by undertaking and documenting at least 6 of 11 specified employee recruitment activities. Failure to comply may cause the contractor to be barred from bidding on future contracts.
Two of the five bids received on the project are subject to the Stockton Municipal Code (SMC), Section 3.68.090, Local Business Preference. Knife River Construction is located within the City of Stockton and is entitled to a five percent bid preference, and Diede Construction, Inc. is located within San Joaquin County and is entitled to a two percent bid preference. However, both Knife River Construction and Diede Construction, Inc. submitted bids that remain higher than the lowest bid after the preference percentages were applied.
The bid from Mozingo Construction, Inc., the lowest responsible bidder, is regular in all respects. Mozingo Construction, Inc. has the proper license to perform the work. Staff recommends awarding the Construction Contract to Mozingo Construction, Inc. in the amount of $572,885. It is anticipated that construction will be completed by the end of 2016.
The project is in conformance with the City’s General Plan, pursuant to California Government Code, Section 65402, and is exempt from the requirements of CEQA as specified under Article 19, Section 15302(c), of the CEQA Guidelines. Staff recommends Council adopt a resolution authorizing the filing of a Notice of Exemption under CEQA.
FINANCIAL SUMMARY
There are sufficient funds in the CIP - Wastewater/Sanitary System Repairs account (437-7702-670) to award the Construction Contract to Mozingo Construction, Inc. of Oakdale for the 2014 Sanitary Sewer Rehabilitation Project, Phase 1 (Project No. M14006) in the amount of $572,885. This project is fully funded with wastewater capital funds (437).
There is no impact to the City’s General Fund or to any other unrestricted fund as a result of taking the recommended action.
