ADOPT RESOLUTION TO AUTHORIZE THE SAFE ROUTES TO SCHOOL SIDEWALK GAP CLOSURE - PHASE 1 PROJECT

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Appropriate federal Surface Transportation Block Grant Program funds in the amount of $1,677,428 to the Safe Routes to School Sidewalk Gap Closure - Phase 1, Project No. WT19013/Federal Project No. ATPSB1L-5008(187).
2. Appropriate Community Development Block Grant funds in the amount of $500,000 to the Safe Routes to School Sidewalk Gap Closure - Phase 1, Project No. WT19013/Federal Project No. ATPSB1L-5008(187).
3. Approve the plans and specifications for the Safe Routes to School Sidewalk Gap Closure - Phase 1, Project No. WT19013/Federal Project No. ATPSB1L-5008(187).
4. Award a Construction Contract in the amount of $2,109,395 to FBD Vanguard Construction, Inc. of Livermore, CA, for the Safe Routes to School Sidewalk Gap Closure - Phase 1, Project No. WT19013/Federal Project No. ATPSB1L-5008(187).
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
The Safe Routes to School Sidewalk Gap Closure - Phase 1 project is funded by federal Active Transportation Program (ATP), federal Surface Transportation Block Grant (STBG) Program, and federal Community Development Block Grant (CDBG) funds. The project will install curbs, gutters, sidewalks, curb ramps, and high visibility crosswalks at four school locations across Stockton - Sierra Nevada Middle School, Victory Elementary, Jane Frederick High School, and Montezuma Elementary School (Attachment A).
On August 28, 2025, the City received eight bids for this project. It is recommended that Council award a Construction Contract to the lowest bidder, FBD Vanguard Construction, Inc., in the amount of $2,109,395. It is also recommended that Council adopt a resolution approving the plans and specifications, and appropriating funds for the project. Construction is anticipated to be completed by the end of 2026.
DISCUSSION
Background
The Safe Routes to School Sidewalk Gap Closure - Phase 1 project is funded by federal ATP, federal STBG program, and federal CDBG funds. The project will install curbs, gutters, sidewalks, curb ramps, and high visibility crosswalks at four school locations across Stockton. The purpose of the project is to provide safer routes for children to walk to and from school by installing sidewalks where they do not exist today and other improvements that enhance pedestrian safety. The project locations are Sierra Nevada Middle School, Victory Elementary, Jane Frederick High School, and Montezuma Elementary School. The project originally included a fifth school location, Fillmore Elementary School. Due to extensive design, right-of-way acquisition, and utility relocations needed at this location, it will be completed as a separate Phase 2 project. All ATP funds for the project will be spent on Phase 1 construction costs. Phase 2 will be constructed using a combination of local and federal funds.
On December 15, 2020, by Resolution No. 2020-12-15-1108, Council approved the filing of Notice of Exemption No. NOE27-20.
On June 18, 2024, by Resolution No. 2024-06-18-1214, Council awarded a Professional Services Contract in the amount of $389,959 to R.E.Y. Engineers, Inc. of Folsom, CA, for design of the Safe Routes to School Sidewalk Gap Closure - Phase 1, Project No. WT19013/Federal Project No. ATPSB1L-5008(187). Phase 1 design for improvements at Sierra Nevada Middle School, Victory Elementary, Jane Frederick High School, and Montezuma Elementary School was completed and funds were allocated by the California Transportation Commission at their March 2025 meeting. This allowed Phase 1 of the project to move forward to construction.
A Disadvantaged Business Enterprise (DBE) is a socially and economically disadvantaged small business owned by a woman or by a specified ethnic group that has been properly certified by Caltrans. These groups include:

A DBE goal of 22.3 percent was established for this project. A pre-bid meeting was held on August 14, 2025, to emphasize the DBE requirements and to provide information on how to meet the project DBE goal. Bids were subsequently received for the project on August 28, 2025. However, on October 3, 2025, the U.S Department of Transportation published an Interim Final Rule amending regulations for the DBE program. The DBE Interim Final Rule stipulated that any contract awarded on or after October 3, 2025, must not have a DBE goal nor include DBE goal compliance requirements. Accordingly, the recommended contract award has no weight or consideration of any DBE goals.
On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA). The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after that date. On July 16, 2019, by Motion No. 2019-07-16-1403, Council extended the CWTA term to August 25, 2024. On August 20, 2024, by Motion No. 2024-08-20-1203, Council extended the CWTA term to August 25, 2029. The CWTA was not applied to this project as federal regulations prohibit the use of such agreements.
Present Situation
On July 18, 2025, the Safe Routes to School Sidewalk Gap Closure - Phase 1, Project No. WT19013/Federal Project No. ATPSB1L-5008(187), was advertised for bids. On August 28, 2025, eight bids were received with the following results:

Federal funding programs prohibit the use of Stockton Municipal Code (SMC) section 3.68.090, Local Business Preference, and Local Employment Ordinance, SMC section 3.68.095.
The bid from FBD Vanguard Construction, Inc. is the lowest bidder and has the proper license to perform the work. It is recommended that Council approve the plans and specifications, and award a Construction Contract to FBD Vanguard Construction, Inc. of Livermore, CA, in the amount of $2,109,395, for the Safe Routes to School Sidewalk Gap Closure - Phase 1, Project No. WT19013/Federal Project No. ATPSB1L-5008(187). Construction is anticipated to be completed by the end of 2026.
FINANCIAL SUMMARY
With the appropriation of federal STBG Program funds in the amount of $1,677,428 and federal CDBG funds in the amount of $500,000 to the Safe Routes to School Sidewalk Gap Closure - Phase 1, Project No. WT19013/Federal Project No. ATBSB1L-5008(187), there will be sufficient funds to award a Construction Contract to FBD Vanguard Construction, Inc. in the amount of $2,109,395.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
