ADOPT A RESOLUTION OF INTENTION TO ANNEX TERRITORY AND TO FORM A NEW ZONE IN THE STOCKTON CONSOLIDATED STORM DRAINAGE MAINTENANCE ASSESSMENT DISTRICT

RECOMMENDATION

 

It is recommended that the City Council approve a Resolution of Intention to:

 

1.                     Provide intent to annex territory to a Municipal Improvement District and to form the Stockton Consolidated Storm Drainage Maintenance Assessment District No. 2005-1, Verona Estates, Zone 16, to maintain and operate storm drainage improvements.

 

2.                     Specify that the public interest would be served by establishing the Zone and levying annual assessments for the costs to maintain and operate the storm drainage improvements.

 

3.                     Preliminarily approve the Engineer’s Report (Attachment A), approve a proposed boundary map and appoint the Engineer of Work.

 

4.                     Set the Public Hearing date on February 3, 2026, and direct the City Clerk to mail public notice to the affected property owners by December 19, 2025, at least forty-five days before the hearing date.

 

It is also recommended that the City Manager be authorized to take appropriate and necessary action to carry out the purpose and intent of this resolution.

Summary

 

To comply with Stockton Municipal Code Chapter 13.20 Stormwater Quality Control Criteria Plan (SWQCCP), the Verona Estates, Zone 16 development must install a stormwater quality treatment device. To fund the device’s maintenance and operation, a new zone must be formed in the City of Stockton Consolidated Storm Drainage Maintenance Assessment District No. 2005-1.

 

All property owners subject to assessment for the storm drain improvements' annual costs submitted written consents for annexation to the City Clerk. Wong Engineers, Inc. of Stockton, California, serving as the Engineer of Work, prepared the attached Engineer’s Report and submitted it for preliminary review and approval, including the annual operation and maintenance cost estimates.

 

Staff recommends that the City Council approve the proposed Resolution to schedule the Public Hearing on February 3, 2026.

 

 

 

DISCUSSION

 

Background

 

On November 1, 2016, the Central Valley Regional Water Quality Control Board issued the City of Stockton a revised Stormwater National Pollution Discharge Elimination System (NPDES) Permit (Order No. R5-2016-0040-002). The NPDES Permit is a regulatory program under the Clean Water Act administered by the U.S. Environmental Protection Agency (EPA) and state agencies. It is designed to control water pollution by regulating point sources that discharge stormwater runoff into waters of the United States.

 

Verona Estates, Zone 16 (Attachment B) consists of a 20-lot subdivision in the southeastern area of the City of Stockton. Lots 1 through 16 will be required to participate in the maintenance of the improvement. Lots 17 through 20 will not use the device and are not subject to the assessment. Individual private bioretention areas for each lot will not be maintained by the assessment district. These areas will be maintained by each individual property owner.

 

To comply with the SWQCCP and NPDES permit requirements, the Verona Estates, Zone 16 subdivision proposed to install and maintain a Contech CDS 2015-4-C Hydrodynamic Separator (Separator) on Susan Way. The Separator is a stormwater treatment device approved by the City of Stockton SWQCCP for treating stormwater runoff from this project site.

 

Present Situation

 

The Conditions of Approval for any development project require Owners/Developers/Successors-in-Interest (ODS) to install certain public stormwater quality improvements and provide operations and maintenance services for the proposed treatment features. As a result, and if approved, Verona Estates, Zone 16, will be created within the existing Consolidated Storm Drainage Maintenance Assessment District No. 2005-1 (Attachment C) to fund costs associated with operating, maintaining, and replacing the Separator.

 

Funding for Zone 16 will be provided through an annual assessment based on the stormwater runoff from individual parcels. The initial annual assessment for each Verona Estates, Zone 16, parcel in FY 2026-27 totals $1,244.38. Subsequent assessments will be presented to the City Council for consideration annually.

 

The maximum annual assessment may increase each year by the greater of 3% or the rise in the Consumer Price Index (CPI), if needed to cover higher maintenance costs.

 

FINANCIAL SUMMARY

 

The City of Stockton has no financial responsibility for the Stockton Consolidated Storm Drainage Maintenance Assessment District No. 2005-1 annexation, Zone 16 formation, or ongoing maintenance. All costs are paid by the property owner/developer through the annual tax roll.

 

This annexation sets a maximum assessment. The actual FY 2026-2027 levy on developed parcels will be set during the annual Stockton Consolidated Storm Drainage Maintenance District 2005-1 budget process.
