APPROVE RESOLUTION TO AUTHORIZE THE FREMONT SQUARE SIDEWALK RECONSTRUCTION PATH

RECOMMENDATION
It is recommended that the City Council adopt a resolution authorizing the City Manager to:
1. Approve the plans and specifications for the Fremont Square Sidewalk Reconstruction Path (Project No. PW1438/ATPL-5008(140)).
2. Award a Construction Contract in the amount of $480,971.20 to A.M. Stephens Construction Co., Inc. of Lodi, CA, for the Fremont Square Sidewalk Reconstruction Path (Project No. PW1438/ATPL-5008(140)).
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
On January 13, 2015, Council accepted the award of a $728,000.00 Active Transportation Program (ATP) grant for the Fremont Square Sidewalk Reconstruction Path project. Council action at that time also authorized the filing of a Notice of Exemption under the California Environmental Quality Act (CEQA) by Resolution No. 2015-01-13-1201. The project was included in the Fiscal Year (FY) 2015-20 Capital Improvement Program (CIP).
The Fremont Square Sidewalk Reconstruction Path project is located within Fremont Square Park bounded by San Joaquin, Sutter, Lindsay, and Fremont Streets in Stockton. The project will reconstruct the perimeter sidewalks, remove and replace curb ramps, relocate pedestrian lighting, add bicycle racks, remove/trim trees, and restore irrigation/turf. The City retained Siegfried Engineering, Inc. to prepare the plans and specifications for the project.
The initial bid process for this project resulted in high bid prices and on April 11, 2017, Council rejected all bids. The project was rebid with a base bid and an additive bid alternate to facilitate awarding a project within the available funds. On May 18, 2017, the City received two bids for the project. A.M. Stephens Construction Co., Inc. is the apparent low bidder for the project. Staff recommends award of the Construction Contract to the lowest responsive bidder, A.M. Stephens Construction Co., Inc., in the amount of $480,971.20. The remaining funding will be used for contingencies, change orders, construction management and staff costs. Staff also recommends that Council adopt a resolution to approve the plans and specifications for the project. Construction is anticipated to begin by the end of summer and be completed in spring 2018.
DISCUSSION
Background
The ATP was created in September 2013 by Senate Bill 99 (Chapter 359, Statutes of 2013) and Assembly Bill 101 (Chapter 354, Statutes of 2013) to encourage increased use of active modes of transportation, such as bicycling and walking.
On May 6, 2014, by Motion No. 2014-05-06-1208, Council authorized the submission of 19 grant applications for funding under the ATP Cycle 1 statewide and regional call for projects. The City was awarded a total of approximately $4.6 million for seven of the applications, four at the statewide level and three at the regional level. The Fremont Square Sidewalk Reconstruction Path project was one of the four approved projects awarded statewide funding. The total ATP grant award received for the Fremont Square Sidewalk Reconstruction Path project was $728,000. On January 13, 2015, by Resolution No. 2015-01-13-1201, Council accepted and appropriated $728,000 of ATP State grant funds for the Fremont Square Sidewalk Reconstruction Path project and authorized the filing of a Notice of Exemption under CEQA (Attachment B). The project was included in the FY 2015-20 CIP.
The Fremont Square Sidewalk Reconstruction Path project is located within Fremont Square Park bounded by San Joaquin, Sutter, Lindsay, and Fremont Streets in Stockton (Attachment A - Vicinity Map). The project will reconstruct the existing sidewalks along the perimeter of the Fremont Square Park with a rubberized surface. The project will also remove and replace curb ramps, relocate pedestrian lighting, add bicycle racks, remove/trim trees, and restore irrigation/turf.
On January 7, 2016, the City retained Siegfried Engineering, Inc. to prepare the plans and specifications for construction of the project. The design of the project was completed, and in June 2016 the California Transportation Commission allocated construction funds. The project was advertised for bids, and on September 22, 2016, the City received three bids. On April 11, 2017, Council rejected all three bids due to bids being higher than the available funds.
Present Situation
On April 13, 2017, the project was re-advertised with a restructured scope of work that has a base bid and one additive bid alternate. The additive alternate bid is optional work that can be included with the apparent low bidder’s base bid provided there is available funding. The State ATP funding restrictions prohibit the use of the Local Employment Ordinance Stockton Municipal Code (SMC) section 3.68.095 and the Local Business Preference Ordinance SMC section 3.68.090 on this project. The funding restrictions also exclude the use of federal Disadvantage Business Enterprise provisions.
On July 26, 2016, Council adopted a Community Workforce and Training Agreement (CWTA). The CWTA became effective August 25, 2016, and applies to all Public Works projects over $1 million that are bid after the effective date noted above. As the estimated project cost was less than $1 million, the CWTA does not apply to this project.
The bid from A.M. Stephens Construction Co., Inc., the lowest responsive bidder, is regular in all respects. A.M. Stephens Construction Co., Inc. has the proper license to perform the work, and their bid is approximately seven percent lower than the engineer’s estimate. There are sufficient funds to award the additive alternate bid. Staff recommends Council approve the plans and specifications for the project and award a Construction Contract to A.M. Stephens Construction Co., Inc. in the amount of $480,971.20. Construction is anticipated to begin by the end of summer and be completed in spring 2018.
FINANCIAL SUMMARY
The project is fully funded with State ATP funds that have been accepted and appropriated. There is no local match requirement.
After expenditures for the design phase, the project has an unencumbered balance of $662,000 available for the construction phase. There are sufficient funds to award a Construction Contract to A.M. Stephens Construction Co., Inc., in the amount of $480,971.20, for construction work on the Fremont Square Sidewalk Reconstruction Path project (PW1438; 308-3020-640). The remaining funding will be used for contingencies, change orders, construction management and staff costs. No additional appropriations are necessary to complete this project.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
