ADOPT A RESOLUTION TO AWARD A CONTRACT TO TNT INDUSTRIAL CONTRACTORS, INC. FOR THE REGIONAL WASTEWATER CONTROL FACILITY SOUTH BIOSCRUBBER REPAIRS

RECOMMENDATION

 

It is recommended that the City Council adopt a resolution to:

 

1.                     Approve the filing of Notice of Exemption No. NOE01-25 under the California Environmental Quality Act (CEQA) for the Regional Wastewater Control Facility (RWCF) South Bioscrubber Repair (Exhibit 1 to the Resolution).

 

2.                     Approve the project Plans and Specifications for the RWCF South Bioscrubber Repair (Exhibit 2 to the Resolution).

 

3.                     Award a $646,927 Construction Contract to TNT Industrial Contractors, Inc. of Sacramento, CA, for the RWCF South Bioscrubber Repair (Exhibit 3 to the Resolution).

 

It is further recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary

 

The Municipal Utilities Department (MUD) is comprised of three enterprise funds including Water, Wastewater and Stormwater Utilities. The Wastewater Utility features a sanitary sewer collection system of approximately 900 miles of gravity sewer main, 554 miles of lower lateral pipe, 27 pump stations, and 30 miles of pressurized force main that route sewage for treatment at the Regional Wastewater Control Facility (RWCF). The system collects sewage from properties within the City, special districts outside the City, and certain areas within San Joaquin County. The RWCF is an advanced tertiary treatment facility with a 55 million gallon per day capacity and is located adjacent to the San Joaquin River.

 

The RWCF includes two (2) onsite biological odor control units or bioscrubbers. Bioscrubbers are used to filter air in the RWCF Headworks Building. A maintenance staff inspection of the South Bioscrubber discovered that the unit needs repair due to a broken support structure and other items.

 

If approved by the City Council, this action will award a construction contract in the amount of $646,927 to TNT Industrial Contractors, Inc. of Sacramento, CA, for the RWCF South Bioscrubber Repair.

 

 

 

DISCUSSION

 

Background

 

The headworks is the first treatment step for untreated sewage entering the treatment plant. The bioscrubbers treat the ventilated air from the headworks building for the reduction of odorous hydrogen sulfide gas (H2S) as well as other airborne constituents. The biological treatment contained within the bioscrubbers include filter media and fiberglass supporting structure.

 

As part of the 2024-29 Capital Improvement Program, a project was created to repair the south bioscrubber in FY 2025-2026. However, in November 2024, an inspection of the south bioscrubber by maintenance staff discovered that the support structure for the filter media was broken and the bioscrubber tank was cracked. The discovery prompted MUD staff to accelerate the repair project to ensure that the south bioscrubber can be placed back in service to effectively reduce hazardous odors associated with the sewer treatment process.

 

The RWCF South Bioscrubber Repairs Project includes the removal, hauling, and disposal of the existing lava rock media, demolition of the existing support grating and mesh screen, removal and salvage of the existing air distribution plates, furnishing and installing new media, new mesh screen, and new support grating, reinstalling existing air distribution plates, and repairing the bioscrubber leaks.

 

On December 6, 2024, the MUD advertised the project in the Stockton Record and on the City Bid Flash webpage. Additionally, a notice with a brief project description was mailed to 102 contractors holding a Class “A” license and notifications were sent through Ask Stockton.

 

Present Situation

 

A non-mandatory pre-bid conference meeting was held on January 9, 2025. TNT Industrial Contractors, Inc., Blocka Construction, Inc., and Valentine Corporation attended the pre-bid conference. On Thursday, January 23, 2025, six (6) sealed bids were received and publicly opened by the City Clerk with the following results:

The bid submitted by TNT Industrial Contractors, Inc. of Sacramento, CA, is regular in all aspects and complies with the project specifications.

 

It is recommended that the City Council award a construction contract in the amount of $646,927 to TNT Industrial Contractors, Inc. of Sacramento, CA, for the RWCF South Bioscrubber Repairs.

 

Local Employment Ordinance

 

The contract amount is over $100,000 and subject to the Local Employment Ordinance, which requires that “all City contracts for public works or improvements of estimated value or City subsidy of $100,000 or more shall contain provisions pursuant to which the contractor promises to make a good faith effort, with the assistance of local labor union hiring halls or community organizations designated by the City to employ qualified individuals who are, and have been for one year prior to the effective date of the contract, residents of Stockton in sufficient numbers so that no less than 50 percent of the contractor’s total construction workforce, including any subcontractor workforce, measured in labor work hours, is comprised of Stockton residents.”

 

The Local Preference Ordinance, which states that “preference shall be given to the purchase of supplies, materials, equipment, and contractual services from local merchants, quality and price being equal,” does not apply to the project because none of the bidders is located within the limits of City of Stockton or San Joaquin County.

 

The project is under $1,000,000 and not subject to the Community Workforce and Training Agreement.

 

Environmental Clearance

 

It has been determined that this project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) guidelines as specified under Article 19, Section 15302, Class 2 (c) of the CEQA guidelines because it concerns replacement or reconstruction of an existing public facility where the new structure will be located on the same site as the structure replaced and will have substantially the same purpose and capacity as the structure replaced.

 

In addition, the proposed project is consistent with the 2040 Stockton General Plan (Land Use Policy 6.3) because it improves existing utility services to ensure that all neighborhoods have access to well-maintained public facilities and utilities that meet community service needs.

 

Following approval by the City Council, staff will file and post the approved Notice of Exemption in compliance with CEQA Guidelines section 15062.

 

FINANCIAL SUMMARY

 

There are sufficient funds in the Wastewater Capital Improvement Budget (6518-000-800007-610-612-00-65-000-000) for Project No. UW25028 to award a $646,927 construction contract to TNT Industrial Contractors, Inc. for the RWCF South Bioscrubber Repair.

 

This action has no impact on the General Fund or any other unrestricted funds.
