APPROVE MOTION TO REJECT BIDS FOR THE GRUPE PARK PICKLEBALL COURTS PROJECT

RECOMMENDATION

 

It is recommended that the City Council approve a motion to reject all bids received for the Grupe Park Pickleball Courts, Project No. WP25033, pursuant to Stockton Municipal Code section 3.68.160(B).

 

It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary

 

The Grupe Park Pickleball Courts project will remove the three existing tennis courts and install 10 new permanent pickleball courts, new fencing, and new benches at Grupe Park (Attachment A). These courts will be the first dedicated pickleball courts at a City park.

 

On January 22, 2026, the City received three bids for this project. CWS Construction Group, Inc. of Novato, CA, the apparent lowest bidder, submitted a bid in the amount of $207,484, but requested a bid relief due to a bid error (Attachment B).

 

Swierstok Enterprise, Inc. dba Pro Builders of Orangevale, CA, the apparent second lowest and responsive bidder, submitted a bid in the amount of $394,386, which is approximately 34 percent higher than the Engineer’s Estimate. There are insufficient funds to award the project for this bid amount.

 

Pursuant to Stockton Municipal Code (SMC) section 3.68.160(B), staff recommends Council approve a motion to reject all bids received.  The project will be re-advertised at a later date with a revised scope to possibly receive more favorable bids within the available budget.

 

DISCUSSION

Background

 

On July 9, 2024, by Resolution No. 2024-07-09-1508, Council allocated $3 million in discretionary funding for various Council priority projects Citywide. The funding provided $302,500 for the Grupe Park Pickleball Courts project. Design of the Grupe Park Pickleball Courts project was completed in December 2025, and the project was advertised for construction bids.

 

The project will remove the three existing tennis courts and install 10 new permanent pickleball courts at Grupe Park (Attachment A). The project includes removing the existing tennis court posts, installing a new high-galvanized chain-link fence, and modifying the existing perimeter fence. The existing benches will also be removed, and new benches will be installed. A new electrical conduit will be installed for future electrical work. These courts will be the first dedicated pickleball courts at a City park.

 

Present Situation

 

On December 18, 2025, the Grupe Park Pickleball Courts, Project No. WP25033, was advertised for bids.  On January 22, 2026, three bids were received with the following results:

The requirements of SMC section 3.68.090, Local Business Preference, apply to this project. However, all the bidders are located outside the City of Stockton and San Joaquin County and are not entitled to a bid preference. The Local Employment Ordinance, SMC section 3.68.095, also applies to this contract.

 

CWS Construction Group, Inc. of Novato, CA, the apparent lowest  bidder, submitted a bid in the amount of $207,484, but requested a bid relief due to a bid error (Attachment B).

 

Swierstok Enterprise, Inc. dba Pro Builders of Orangevale, CA, the apparent second lowest and responsive bidder, submitted a bid in the amount of $394,386, which is approximately 34 percent higher than the Engineer’s Estimate.  Zara Construction, Inc.’s bid was non-responsive due to a blank bid form. There are insufficient funds to award the project for this bid amount.

 

SMC section 3.68.160(B) provides that Council shall award a contract to the lowest and best regular responsible bidder or reject all bids. Staff recommends Council approve a motion to reject all bids received. The project will be re-advertised at a later date with a revised scope to possibly receive more favorable bids within the available budget.

 

FINANCIAL SUMMARY

 

There are sufficient funds in the Grupe Park Pickleball Courts, Project No. WP25033, for the re-advertisement process.
