ADOPT A RESOLUTION AND RATIFY THE EMERGENCY PURCHASE OF POLICE PURSUIT CHEVROLET SILVERADO TRUCKS WITH FUTURE CHEVROLET

RECOMMENDATION
It is recommended that the City Council adopt a resolution to:
1. Appropriate funds in the amount of $499,036.35 from the Fleet Internal Service Fund Balance to the operating Fleet Internal Service Fund, Equipment Acquisition Account.
2. Approve findings pursuant to Stockton Municipal Code section 3.68.070 in support of an exception to the competitive bidding process.
3. Approve findings and ratify the City Manager’s approval to execute an Emergency Purchase Order to Future Chevrolet of Sacramento, CA, in the amount of $598,843.62, for the purchase of six police pursuit Chevrolet Silverado trucks for the Police Department.
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this resolution.

Summary
On May 29, 2024, the City Manager approved an Emergency Purchase Order (PO) to Future Chevrolet of Sacramento, CA, in the amount of $598,843.62, for the purchase of six police pursuit Chevrolet Silverado trucks for the Police Department.
It is recommended that Council adopt a resolution ratifying the City Manager’s approval to execute an Emergency PO with Future Chevrolet of Sacramento, CA, in the amount of $598,843.62, for the purchase of six police pursuit Chevrolet Silverado trucks.
DISCUSSION
Background
On January 25, 2022, by Resolution No. 2022-01-25-0603, Council accepted funding from the Budget Act of 2021 for law enforcement use. On November 6, 2023, the Police Department submitted a request to the City Manager for the purchase of an additional police pursuit rated truck for the Strategic Community Officer (SCO) section that would aid in the transportation of arrestee's belongings, clean-ups, and community engagement activities. Having a truck would allow Police SCOs to expand patrol efforts to various terrains and have a higher clearance level when patrolling non-paved areas.
The Police Department currently has multiple marked patrol units that require replacement. These vehicles have surpassed their stated lifecycle for performance and efficiency, which is six years and/or 100,000 miles. The Police-Fleet Committee has recommended diversifying fleet assets and requested the purchase of additional police pursuit trucks for the SCO section with the Fleet Internal Service Fund (ISF).
Future Chevrolet of Sacramento, CA, had four police pursuit Chevrolet Silverado trucks on the lot and two more in production. The available units have all up-fitting and lighting, which is equivalent to the current police patrol specification. They are ready to be put in service immediately after purchase and pre-delivery inspection.
Present Situation
On May 9, 2024, Police Department staff test drove the units at the dealership and concluded that the trucks met the requirements for patrol use and recommended moving forward with the purchase of the four available trucks, as well as two additional trucks currently in production, for the SCO section.
On June 10, 2024, an Emergency PO was issued to Future Chevrolet of Sacramento, CA, for the six police pursuit Chevrolet Silverado trucks from Future Chevrolet due to the frequent cancellations of orders, recent supply chain issues, and long lead times on up-fitting.
The Emergency PO was processed in accordance with Stockton Municipal Code (SMC) section 3.68.070, which provides an exception to the competitive bidding process under certain circumstances, including cases of emergencies. It is the goal of the department to bring emergency procurements to Council by the next scheduled Council meeting following the City Manager’s execution. However, workload, assigned priorities, and staffing shortages have caused delays in the timeline.
It is recommended that Council adopt a resolution ratifying the City Manager’s approval for the total expenditure of $598,843.62 for the emergency purchase of six police pursuit Chevrolet Silverado trucks from Future Chevrolet of Sacramento, CA, and the appropriate findings which support an exception to the competitive bidding process.
Findings
Pursuant to SMC section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. These findings include:
1. The use of an Emergency PO procurement is appropriate for these procurements due to supply chain issues in ordering and receiving vehicles.
2. Public Works sought out multiple resources for the supply of vehicles. Only one source was available and turn-key-ready.
3. Other agencies were competing to secure the same vehicles, and any delay would have resulted in the City not being able to readily secure the needed vehicles.
4. The use of the Emergency PO procurement is appropriate for this purchase because it allows the City to be more competitive in acquiring equipment in current industry conditions as vendors struggle to honor quoted pricing through the duration of a traditional government low-bid procurement process.
FINANCIAL SUMMARY
With the appropriation of funds in the amount of $499,036.35, from the Fleet ISF Balance to the operating Fleet ISF, Equipment Acquisition Account, there will be sufficient funding for the purchase of six police pursuit Chevrolet Silverado trucks from Future Chevrolet.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
