RECOMMENDATION
It is recommended that the City Council approve a motion to authorize Contract Amendment No. 7 with Robertson-Bryan, Inc., of Elk Grove, CA. This amendment, in the amount of $311,533, extends the contract for professional engineering services necessary to complete the Regional Wastewater Control Facility (RWCF) Modifications Project.
It is further recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.

Summary
The Municipal Utilities Department (MUD) includes three utilities supported by user fees and regulated for the protection of public health and the environment: Water, Wastewater, and Stormwater. The Wastewater Utility operates a sanitary sewer system with about 900 miles of gravity mains, 554 miles of lower laterals, 27 pump stations, and 30 miles of force mains that convey sewage to the Regional Wastewater Control Facility (RWCF) for treatment. The system serves properties within the City, nearby special districts, and parts of San Joaquin County. The RWCF is an advanced tertiary wastewater treatment plant with a 55 million gallons per day capacity located next to the San Joaquin River.
On November 15, 2016, the Stockton City Council awarded a Progressive Design-Build Contract with AECOM Infrastructure and W.M. Lyles, Inc., a Joint Venture (JV), for the RWCF Modifications Project improvements identified in the 2011 Capital Improvement and Energy Management Plan (CIEMP) and necessary to meet treated wastewater discharge limits stipulated by the Regional Water Quality Control Board.
The RWCF Modifications Project includes key upgrades to comply with permit required effluent limits, in addition to replacing equipment and processes that are 40 to 70 years old and beyond their useful life.
If approved by the City Council, this action will add $311,533 to the existing contract with Robertson-Bryan Inc. (RBI) and extend its term by three months to support the continual provision of project management services through the completion of the RWCF Modifications Project. Contract Amendment No. 7 will revise the total contract amount to $4,511,222 and extend it until March 31, 2026.
DISCUSSION
Background
On August 8, 2017, by Motion No. 2017-08-08-1105, the City Council awarded a $991,362 Professional Services Contract with RBI, to provide project management services for the RWCF Modifications Project.
On July 30, 2019, by Motion No. 2019-07-30-1104, the City Council authorized contract change order No. 2 for $2,748,524 with RBI to increase project management staffing and provide project management services until October 11, 2023.
Subsequent contract amendments increased the contract amount by $459,803 to $4,199,021 and extended the contract term until December 31, 2025.
Present Situation
The JV is nearing the fulfillment of all substantial and final completion requirements necessary to close out the RWCF Modifications Project. To achieve these requirements, the JV is required to deliver a fully automatic, operable tertiary treatment system, and a finalized Acceptance Test Report for the facility.
The MUD operations staff has encountered complications with the new tertiary system. The JV and MUD operations and management teams are currently investigating the causes of system issues and the required adjustments necessary to achieve full operations and acceptance approval.
To support the successful completion of the project including the commissioning and acceptance of the tertiary treatment system, staff recommend amending the contract for project management services necessary to ensure that all remaining tasks and close out reports are completed to fully comply with project requirements.
Staff recommend the City Council approve Amendment No. 7 with Robertson-Bryan, Inc. of Elk Grove, CA, in the amount of $311,533, for a term of an additional three months (Attachment A).
If approved, this action will authorize RBI to continue providing project management services through the completion of Phase 2 of the RWCF Modifications Project, anticipated to occur in spring 2026.
FINANCIAL SUMMARY
There are sufficient funds available in the Wastewater Capital Improvement Project UW16022, account 6518-000-800007-610-612-00-65-000-000 to fund Amendment No. 7 for $311,533 with RBI to provide professional project management and engineering services.
This action has no impact on the General Fund or any other restricted funds.
