body

Summary

Eight Mile Development, Inc. (Developer) is requesting a reimbursement agreement for the dedication of land and construction of an 11.2-acre Community Park within the Spanos Westlake Villages Development in accordance with the approved Subdivision Agreement conditions of approval (see Attachment A - Location Map). As specified in the conditions, the Developer is only eligible to receive a maximum reimbursement of $948,632 that equates to the total amount of Parkland Public Facility Fees paid within Westlake Villages Development subdivision Units #2 (Village O), #3 (Village P), and #4 (Village Q), consisting of 322 residential lots. The Developer did not pay any Parkland Public Facility Fees on any other subsequent subdivisions, due to their voluntary participation in the Stockton Economic Stimulus Plan (SESP), which waived the Parkland Public Facility Fees.

DISCUSSION

Background

On January 31, 2006, the Council approved the final subdivision map entitled Westlake Villages Unit No. 1 and Subdivision Agreement for Spanos Family Partnership that specifies conditions of approval (COA) obligations of development, herein referred to as the “Westlake Villages Development”. On March 17, 2020, the City approved a Minor Amendment to the COA for Westlake Villages Development, that amended COA Numbers 9, 11, 21, 34, and 38. COA Number 34 as amended requires the Developer to prepare design plans, dedicate, and construct a 11.2 acre community park site for acceptance by the City and enter into a park reimbursement agreement with the City that requires the City to reimburse the Developer for costs that shall not exceed the total Parkland Public Facility Fee revenue collected by the City through Parkland Public Facility Fees paid for the overall Westlake Villages Development.

Present Situation

The Developer prepared design plans for Parkland Improvements (Plan number 5552C) and dedicated the 11.2-acre Parkland site to the City under Grant Deed - APN 066-050-15 recorded on August 11, 2025 (Document No.: 2025-067310). The maximum allowable reimbursement for Parkland is $60,000 per acre in accordance with the Public Facility Fee Administrative Guidelines. The Developer constructed Parkland Improvements for a reported cost of approximately $6.3 million in accordance with the approved plans that were accepted by the City with a Notice of Completion filed in the office of the Recorder of San Joaquin County, California, on February 11, 2026. At this time, the Developer is requesting reimbursement for the maximum eligible amount of $948,632.

FINANCIAL SUMMARY

Funds are available in the Parkland Public Facility Fund. This action has no impact on the General Fund or any other unrestricted funds.
