Summary

On June 18, 2024, by Resolution No. 2024-06-18-1214, Council authorized the award of a Professional Services Contract, in the amount of $389,959, to R.E.Y. Engineers, Inc. of Folsom, CA, to prepare plans and specifications for the Safe Routes to School Sidewalk Gap Closure project. The project was to install curbs, gutters, sidewalks, Americans with Disabilities Act (ADA) compliant curb ramps, high visibility crosswalks, and pedestrian improvements at traffic signals around five schools spread across Stockton. The primary goal of the project is to create a safer route for children walking to and from school by separating pedestrians from vehicles and implementing additional safety enhancements around school areas.

The project was included in the 2024-29 Five-Year Capital Improvement Plan (CIP).

Professional Services Contract Amendment No. 3 with R.E.Y. Engineers, Inc., in the amount of $410,746, requires Council authorization as the cumulative amount of Professional Services Contract Amendments Nos. 1 through 3 exceed the administrative change order authority allowed under the existing contract.

It is recommended that Council adopt a resolution to authorize Professional Services Contract Amendment No. 3 in the amount of $410,746 with R.E.Y. Engineers, Inc. to provide additional design services for the Fillmore Elementary School location. It is also recommended that Council appropriate funds in the amount of $500,000 from the Community Development Block Grant Funds to the Safe Routes to School Sidewalk Gap Closure Phase 2, Project No. WT19013/Federal Project No. ATPSB1L-5008(187).

It is anticipated that additional design services will be completed by December 2026.

DISCUSSION

Background

On June 18, 2024, by Resolution No. 2024-06-18-1214, Council authorized the award of a Professional Services Contract, in the amount of $389,959, to R.E.Y. Engineers, Inc. of Folsom, CA, to prepare plans and specifications for the Safe Routes to School Sidewalk Gap Closure project. The project was to install curbs, gutters, sidewalks, ADA compliant curb ramps, high visibility crosswalks, and pedestrian improvements at traffic signals around five schools spread across Stockton. The primary goal of the project is to create a safer route for children walking to and from school by separating pedestrians from vehicles and implementing additional safety enhancements around school areas. The project was included in the 2024-29 Five-Year CIP.

The school locations for the Safe Routes to School Sidewalk Gap Closure project were Victory Elementary School, Montezuma Elementary School, Jane Frederick High School, Delta Sierra Middle School, and Fillmore Elementary School. During the preliminary design phase, it was determined that the proposed improvements at Fillmore Elementary School would require a more extensive redesign of the street to accommodate the planned sidewalk enhancements. Additionally, further coordination with utility companies is necessary to address conflicts and relocate affected utilities. Finally, partial right-of-way acquisition will be needed on up to three properties, and additional time is required to ensure that the rights of property owners are fully protected.

Active Transportation Plan funding deadlines required that the construction funding be allocated by the California Transportation Commission (CTC) no later than March 2025. To meet this deadline, the project needed to be split into phases. Phase 1 includes Victory Elementary School, Montezuma Elementary School, Jane Frederick High School, and Delta Sierra Middle School locations. A construction funding request was submitted to the CTC for the Phase 1 project, and construction funds were subsequently allocated to the City. Phase 2 includes Fillmore Elementary School, which will be designed and constructed using a combination of other federal and local funds.

Present Situation

Professional Services Contract Amendments Nos. 1 and 2 with R.E.Y. Engineers, Inc. were previously approved by the City Manager to provide additional surveying and design services for Phase 1 of the project, as required to meet funding compliance requirements.

The Phase 1 project design has been completed and will be advertised for construction. Professional Services Contract Amendment No. 3 will provide funds and additional design services to address the extensive roadway work and utility relocations needed along Poplar Street and Golden Gate Avenue adjacent to Fillmore Elementary School. Professional Services Contract Amendment No. 3 will also provide additional right-of-way engineering and assistance needed from R.E.Y. Engineers, Inc. on the project.

It is recommended that Council adopt a resolution to authorize Professional Services Contract Amendment No. 3 in the amount of $410,746 with R.E.Y. Engineers, Inc. to provide additional design services for the Fillmore Elementary School location. Professional Services Contract Amendment No. 3 requires Council authorization as the cumulative amount of Professional Services Contract Amendments Nos. 1 through 3 exceed the administrative change order authority allowed under the existing contract. The total revised contract value will be $938,759.

It is also recommended that Council appropriate funds in the amount of $500,000 from the Community Development Block Grant Funds to the Safe Routes to School Sidewalk Gap Closure Phase 2, Project No. WT19013/Federal Project No. ATPSB1L-5008(187). The resolution will sufficiently fund all remaining costs to complete the project, including additional consultant cost and staff costs associated with expanding the project limits.

It is anticipated that additional design services will be completed by December 2026.

FINANCIAL SUMMARY

With the appropriation of $500,000 from the Community Development Block Grant Funds to the Safe Routes to School Sidewalk Gap Closure Phase 2, Project No. WT19013/Federal Project No. ATPSB1L-5008(187), there will be sufficient funds to authorize Professional Services Contract Amendment No. 3 in the amount of $410,746 with R.E.Y. Engineers, Inc. to complete project design.

There is no impact to the City's General Fund or any other unrestricted fund as a result of taking the recommended actions.
