recommended action
RECOMMENDATION
It is recommended that the City Council approve a motion to reject all bids received for the Channel Street Corridor Improvements, Project No. WT23031, pursuant to Stockton Municipal Code section 3.68.160(B).
It is also recommended that the City Manager be authorized to take appropriate and necessary actions to carry out the purpose and intent of this motion.
body
Summary
The Channel Street Corridor Improvements project is funded by the federal Active Transportation Program (ATP) and local Measure K grant funds. The grant funding for this project was secured by the San Joaquin Regional Rail Commission (SJRRC). The Channel Street Corridor Improvements project will install various measures including crosswalks, bicycle lanes, bulb-outs, sidewalks, curb and gutter, pavement, and lighting to improve the project area's safety and aesthetics. The project is located along Channel Street between Aurora Street and Stanislaus Street, and on Aurora Street, Grant Street, and Stanislaus Street between Miner Avenue and Weber Avenue (Attachment A).
SJRRC took the lead in designing the project, and the City will take the lead in construction of the project.
On August 22, 2024, the City received five bids for this project. However, the Notice Inviting Bids published in The Record stated that the Local Business Preference Ordinance, Local Employment Ordinance, and Citywide Workforce Training Agreement (CWTA) applied to the project. Unfortunately, the project is funded, in part, with ATP funding, which does not allow use of the Local Business Preference and the Local Employment Ordinances as well as the CWTA. In light of the noticing error, the City Attorney’s Office recommended that all bids be rejected, and the project re-advertised. Therefore, pursuant to Stockton Municipal Code (SMC) section 3.68.160(B), staff recommends Council approve a motion to reject all bids received.
The project was re-advertised on September 5, 2024. New bids are due on September 26, 2024.
DISCUSSION
Background
The Channel Street Corridor Improvements project is sponsored by the SJRRC and is funded by federal ATP and local Measure K grant funds. The project will install various measures including crosswalks, bicycle lanes, bulb-outs, sidewalks, curb and gutter, pavement, and lighting to improve the project area's safety and aesthetics. The project is located along Channel Street between Aurora Street and Stanislaus Street, and on Aurora Street, Grant Street, and Stanislaus Street between Miner Avenue and Weber Avenue (Attachment A).
The SJRRC is funding this project and took the lead in completing the design of the project. The City will assume the lead role during the construction phase of the project. The City/SJRRC Cooperative Agreement has been drafted outlining the roles of the City and SJRRC during the construction of the project and will be presented to Council in the near future.
Present Situation
On July 19, 2024, the Channel Street Corridor Improvements, Project No. WT23031, was advertised for bids. On August 22, 2024, five bids were received with the following results:

United Pavement Maintenance of Hughson, CA, submitted the lowest bid in the amount of $6,858,324.11. However, the Notice Inviting Bids published in The Record erroneously stated that the Local Business Preference Ordinance, Local Employment Ordinance, and CWTA applied to the project. Unfortunately, the project is funded, in part, with ATP funding which does not allow use of the Local Business Preference and Local Employment Ordinances as well as the CWTA. The City Attorney’s Office recommended that all bids be rejected, and the project re-advertised.
SMC section 3.68.160(B) provides that Council shall award a contract to the lowest and best regular responsible bidder or reject all bids. Staff recommends Council approve a motion to reject all bids received. The project advertisement documents have been revised. The project was re-advertised on September 5, 2024, and bids are due September 26, 2024.
FINANCIAL SUMMARY
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended action.
