On September 14, 2021, Council approved use of $78,052,072 in American Rescue Plan Act Coronavirus State and Local Fiscal Recovery Funds (ARPA). The requirements of Stockton Municipal Code (SMC) section 3.68.090, Local Business Preference, and SMC section 3.68.095, Local Employment Ordinance, do not apply to this project due to federal funding limitations.
The base bid from F&H Construction, the lowest responsible bidder, is regular in all respects and has the proper license to perform the work. It is recommended that Council approve the plans and specifications for the project, transfer of necessary funds for the project, and award a Construction Contract to F&H Construction of Lodi, CA, in the amount of $10,473,000, which includes the base bid and five additive alternates.
Due to increased bid results, multiple fund transfers are needed to facilitate the delivery of the Animal Shelter Renovation project. The surpluses from the below Council approved discretionary projects will be transferred to the Animal Shelter Renovation project:
• The Teen Impact Center Roof Replacement, Project No. CR22002, has been completed. Unused funds of $559,065 will be transferred.
• The Aquatic Facilities Renovations - Victory Park Pool, Project No. CR18020, received favorable bids resulting in surplus funds. Therefore, $1,996,573 will be transferred.
• The Van Buskirk Building Demolition, Project No. WP24025, received favorable bids resulting in surplus funds. Therefore, $140,000 will be transferred.
• The Weber Point Shade Structure Fabric, Project No. WP22033, received favorable bids resulting in surplus funds. Therefore, $200,000 will be transferred.
In total, the transfer of $2,895,638 in Council approved discretionary funding allows for the award of the Construction Contract and all five additive alternates.
The project is in conformance with the City’s General Plan, pursuant to California Government Code, section 65402, and is categorically exempt from the requirements of CEQA as specified under Section 15303 of the CEQA Guidelines. The activities related to this project constitute a discretionary project under the City’s jurisdiction and qualifies as a project that does not have a significant effect on the environment. The resolution will approve the filing of Notice of Exemption No. NOE37-24 under CEQA.
On May 20, 2024, the City advertised a Request for Proposals (RFP) for construction management services for the Animal Shelter Renovation, Project No. P023001. On June 12, 2024, three proposals were received from the following firms:
• Jones Lang LaSalle Americas, Inc. (Campbell, CA)
• Roebbelen (El Dorado Hills, CA)
• UNICO Engineering (Folsom, CA)
The Selection Committee evaluated the proposals based on each firm’s understanding of work, experience with similar kinds of projects, staff qualifications, technical ability, project approach, cost, and local preference.
UNICO Engineering received the highest ranking, based on the noted criteria, and was determined to be the most qualified and highest ranked firm for this project. Staff negotiated a fee in the amount of $708,411.20 with UNICO Engineering for construction management services for the Animal Shelter Renovation project. It is recommended that Council adopt a resolution authorizing the City Manager to execute a Professional Services Contract in the amount of $708,411.20 to UNICO Engineering.
Construction will begin in fall 2024 with final completion expected in spring 2026, weather permitting.
Findings Related to Construction Management Services
Pursuant to SMC section 3.68.070, Council may approve findings which support an exception to the competitive bidding process. These findings include:
1. The City does not have sufficient staff resources to perform the necessary construction management services for this project.
2. Use of the RFP process is appropriate for this Professional Services Contract because it relies on the evaluation of professional qualifications and performance as the basis for selection of a vendor. Use of the criteria helps ensure selection of a vendor that will provide the highest quality professional service, which is in the public interest.
3. The City negotiated a contract following solicitation of competitive proposals in accordance with SMC section 3.68.070.A.3.
FINANCIAL SUMMARY
With the transfer of funds from various projects, there will be sufficient funding in Project No. P023001 to fund all construction related costs to complete the project.
There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended actions.
