Summary

The Stockton Channel weir was constructed in 2001 as part of the improvements for the Dean DeCarli Waterfront Plaza in downtown Stockton. The Stockton Channel weir runs parallel with Center Street just north of Weber Avenue.  The Center Street Weir Repair, Project No. WD19008, will repair the leak situated where the weir attaches to the Stockton Channel Sea Wall located at the northwest corner of Weber Avenue and Center Street (Attachment A). The project was included in the 2019-24 Five-Year Capital Improvement Plan (CIP).

The California Environmental Quality Act (CEQA) clearance is required to be filed with the San Joaquin County Recorder’s Office prior to acquiring required permits for the Center Street Weir Repair project.

The project recently completed the environmental evaluation and documentation process and was determined to be exempt under the CEQA Guidelines.  Staff recommends that Council adopt a resolution approving Notice of Exemption No. NOE23-23 under CEQA and to obtain the required permits for the Center Street Weir Repair, Project No. WD19008.

DISCUSSION

Background

The Stockton Channel weir was constructed in 2001 as part of the improvements for the Dean DeCarli Waterfront Plaza in downtown Stockton. Water is pumped from the Stockton Channel to the water fountain adjacent to El Dorado Street.  Water then flows over the Stockton Channel weir that runs parallel with Center Street just north of Weber Avenue.  The weir is more commonly referred to as the Center Street weir.  The Center Street weir is a structure built to regulate the water level, in coordination with pumps, within the water area bounded by El Dorado Street, Center Street, Weber Avenue, and Channel Street. The weir structure has developed a leak on the southern portion of the weir.  The Center Street Weir Repair, Project No. WD19008, will repair the leak situated where the weir attaches to the Stockton Channel Sea Wall located at the northwest corner of Weber Avenue and Center Street (Attachment A).  Repairs include the removal of stone protection material within the channel, installation of temporary cofferdam, removal of existing concrete seawall, sheet pile concrete cap, roadway, and sidewalk repairs. The project was included in the 2019-24 Five-Year CIP.

Present Situation

The CEQA clearance is required to be filed with the San Joaquin County Recorder’s Office prior to acquiring required permits for the Center Street Weir Repair project.  The project is in conformance with the City’s General Plan, pursuant to California Government Code, section 65402, and is categorically exempt from the requirements of CEQA as specified under Section 15301(c) of the CEQA Guidelines. The activities related to this project constitute a discretionary project under the City’s jurisdiction and qualifies as a project that does not have a significant effect on the environment.  Staff recommends that Council adopt a resolution approving Notice of Exemption No. NOE23-23 under CEQA and to obtain the required permits for the Center Street Weir Repair, Project No. WD19008.

The project design is substantially complete, and permits are being acquired from the State Water Resources Control Board, California Department of Fish and Wildlife, and the U.S. Army Corps of Engineers.  The project will be advertised for construction when all permits are received, which is estimated to be spring of 2025.  Staff will reevaluate the cost of the project once all requirements and conditions are received from the above-mentioned permitting agencies.  In addition, staff is evaluating other conditions of the roadway that may have to be repaired during construction and factor into the total cost of the project.

In the interim, staff is utilizing emergency procurement provisions to coordinate temporary repairs to remediate the leaks.

FINANCIAL SUMMARY

There is no impact to the City’s General Fund or any other unrestricted fund as a result of taking the recommended action.
