Summary

The Municipal Utilities Department (MUD) operates and maintains a wastewater system that collects and treats an average of 30 million gallons a day of sewage from the City of Stockton under the National Pollution Discharge Elimination System (NPDES) permit criteria before discharging into the San Joaquin River. The wastewater is collected and routed to the Regional Wastewater Control Facility (RWCF) through an extensive network of over 1,500 miles of pipe and 35 pump stations. Currently, the RWCF oxidation ponds provide further biological treatment of the secondary sewer treatment process. The interior service roads for ponds No. 2 and No. 3 are currently in poor condition and need resurfacing.

If approved by the City Council, this action will award a construction contract in the amount of $593,032.26 to Robert Burns Construction, Inc. of Stockton, CA, to perform the necessary work at the oxidation ponds.

DISCUSSION

Background

The Municipal Utilities Department (MUD) operates and maintains its wastewater treatment and disposal system at the Regional Wastewater Control Facility (RWCF) located at 2500 Navy Drive in Stockton. The oxidation ponds at the RWCF are a suspended-growth treatment process that consists of three (3) ponds located across the San Joaquin River from the Stockton RWCF Main plant at 2500 Navy Drive. These ponds include various exterior and interior service roads around their respective perimeters. The interior service roads for ponds No. 2 and No. 3 are in poor condition, and it was determined that the roads need to be resurfaced to provide safe access for staff.

As part of the 2023-28 Capital Improvement Program, a project was created to perform repairs on the levee roads. Seigfried Engineering prepared the plans and specifications for the project. The project design was completed and placed out to bid for the interior levee roads construction work.

Present Situation

On January 25, 2024, the MUD advertised the project in the Stockton Record and posted it to the City’s Bid Flash webpage. Additionally, a brief project description notice was mailed to 99 contractors holding a Class “A” license and notifications were sent through Ask Stockton. A non-mandatory pre-bid conference meeting was held on February 15, 2024, with six (6) prospective bidders in attendance.

On Thursday, February 29, 2024, ten (10) sealed bids were received and publicly opened by the City Clerk with the following results:

Staff recommends that the City Council award a construction contract in the amount of $593,032.26 to Robert Burns Construction, Inc. of Stockton, CA, for the RWCF Oxidation Ponds No. 2 and No. 3 Interior Levee Roads Repair, Project No. UW23016.

Local Employment Ordinance

The contract amount is over $100,000 and subject to the Local Employment Ordinance, which requires that “all City contracts for public works or improvements of estimated value or City subsidy of $100,000 or more shall contain provisions pursuant to which the contractor promises to make a good faith effort, with the assistance of local labor union hiring halls or community organizations designated by the City to employ qualified individuals who are, and have been for one year prior to the effective date of the contract, residents of Stockton in sufficient numbers so that no less than 50 percent of the contractor’s total construction workforce, including any subcontractor workforce, measured in labor work hours, is comprised of Stockton residents.”

The Local Preference Ordinance, which states that “preference shall be given to the purchase of supplies, materials, equipment, and contractual services from local merchants, quality and price being equal,” applies to the project because four (4) bidders are located within the limits of the City of Stockton or San Joaquin County.

The project is under $1,000,000 and is not subject to the Community Workforce and Training Agreement.

Environmental Clearance

It has been determined that this project is categorically exempt from the requirements of the California Environmental Quality Act (CEQA) as specified under Article 19, Section 15302, Class 2 (c) of the CEQA guidelines, as it involves the replacement or reconstruction of an existing public facility where the new structure will be located on the same site and will have substantially the same purpose and capacity as the structure replaced.

In addition, the proposed project is consistent with the Government Code Section 65402 and the 2040 Stockton General Plan (Land Use Policy 6.3) because it improves existing utility services to ensure that all neighborhoods have access to well-maintained public facilities and utilities that meet community service needs.

FINANCIAL SUMMARY

There are sufficient funds in the Wastewater Capital Improvements account to award the construction contract in the amount of $593,032.26 to Robert Burns Construction, Inc. of Stockton, California, for the RWCF Oxidation Ponds No. 2 and No. 3 Interior Levee Roads Repair, Project No. UW23016.

There is no impact to the City’s General Fund or any other unrestricted fund from this action.
